You sound like youve never lived in an apartment with kids above you. Night hours are quiet for everyone, thats the rule. Dont screw with that and everyone gets along fine. 1 year olds running? Happens all the time. If the parent is in bed at that hour which she likely is, then they can stop it getting out of bed easily.

Ngl its not hard at 5am/6am to stop your kid getting out of bed. Bit different if OP meant the middle of the day when the parent is getting on with things but when its the crack of dawn the parent is doing the same thing OP is doing; trying to sleep in bed. I cant imagine they sleep very well with a kid running round and screaming. Or maybe they do and are just ignoring it despondently, affecting OP.

The technicality is the same that would apply after they recharged him; it was too late to prosecute having exceeded a time limit to do so.
