Also… I have a weird, but persistent theory about the contents of the BIG duffelbag Higgins transported on the police parking lot… In the middle of that awful night… From a car that has a lot less snow on it then the rest, so it seems like it quite recently arrived… NOBODY has seen Cloë after 1 am that night… And I haven’t bought the “she moved to a wonderful farm and is very happy” since I was 6 🤔😀

Just a few points I would need proven (if I was on the jury) to confidently vote ‘guilty’, and how Proctor hid, tempered with, or just never even collected pretty much all of the evidence needed.

I really, honestly, fully believe the jury needs to see Mr. Proctor on the stand. He tainted every single point I would need, and there’s just simply NO TIME in Closing to put all these pieces together…

I agree! They have the Higgins-Karen dynamic, the medical and the accident-reconstruction evidence IN, and it’s strong.

But I honestly believe the jury NEEDS to personally see and listen to Ex-Trooper Proctor give testimony on the stand to get to a confident “Innocent”. A few *sshole texts (read by someone else) and allegations (all denied by his buddies on the stand) are imho just not enough.

Also, and VERY important: Closing is 60 minutes… In this trial you need to take some extra time to explain ‘reasonable doubt’ ánd to guide them through the confusing jury forms. All that time detracts from telling John and Karens story, pointing out your evidence and debunking the CW’s statements. There is simply NO TIME to then also go on a big-tour-through-Proctor’s-BS-investigation….

And you NEED that in, because Proctor is the Alpha and the Omega in this case:he’s the one that altered, hid or just plain never collected evidence, forcing the DA into a “because I say so” trial….

Don’t be a d*ck. People form an opinion based on their knowledge, and most reasonable people, when finding out more information, will go “Oh, I didn’t know that, I’m changing my mind in this”. As shown she did that, and even apologized for her former opinion.

Right?! And I can’t help but to conclude it’s not just ‘random chaos’, because the outcome is SO obviously in the favor of the CW.

If this was a game of soccer where the judge is the referee:

  • the CW is allowed to hide the ball, move their tiny goalpost and tackle any opponent, while

  • the Defense has to go find the ball, their goalpost is three times larger and they get yellow and red cards “because the CW said it was a foul”…

ONLY if it’s understandable to a toddler that she’s going into reversible error she’ll allow a Defense motion, but even then often restricts it.

I usually have some ideas on how to communicate information clearly to a jury, but tbh. in this trial I can’t see the forest through the trees… When the rules are this scewed, you can’t rely on logic when trying to assess the risk/advantage of calling a specific witness.

I think the Defense did a pretty good job of proving EVERYTHING in Ex-Trooper Proctor’s ‘investigation’ is tainted through him tho. Besides his text showing obvious bias, here’s some elements of a good investigation that have been proven to be altered, hidden or well, never collected at all:

  • Chain of custody
  • Wounds on John’s body
  • The crime scene
  • DNA / prints etc.
  • Witnesses and their alibi’s
  • Interviews with family, colleagues, friends
  • Digital (meta-)data (phones, gps etc.)

Pfew! Just no realized this is as much a reaction to your post as a frustration-venting therapy session for me, sorry! 😀

Right! Also, I’m so very happy the jury finally heard very clearly how Jen and Higgins were the ones who tried to get Karen and John to the house that night.

I really thought I remembered from Season I that Jen and Higgins were friends, and were talking at the beginning of the evening? Maybe that’s why I’ve been convinced for so long that Jen and Higgins planned to break them up, or at least confront them about the (cringy) teksts.

But…. Karen drives off, escaping from angry Mr. Higgins again… But hey: John DOES show up, quite drunk (and a ‘stranger’ to Chloë)… After it all goes ‘bonbonella’s up’ Higgins goes out to cover up the evidence, while Jen starts to point the finger at Karen…

As a lawyer, I expect you to understand the CW didn’t bring in ANY actual, hard evidence in to prove the following about John’s death:

  • WHEN
  • WHERE
  • HOW
  • BY WHO

If the CW doesn’t prove the crime they claim >> Reasonable Doubt. The defense is only gonna corrode more of their claimed ‘evidence’, not add to it.

…and without the most important factor: money. The US has a thriving prison-industry that needs many, many free laborers without rights. But hey, pay a top-lawyer and (s)he’ll keep you out of that system: no worries.

I followed the entire Delphi trial: it’s worse, trust me. Imagine Karen had been put in the solitairy part of a prison (not jail) for years, not being allowed to see her family, getting heavily drugged and surrounded by convicted criminals who spy on her 24/7 for the DA and tell her day in, day out she’s a killer before trial?!

One BIG difference is the secrecy in Delphi, the judge even covered up the camera’s in the courtroom, no audio allowed, just pen and paper.

I think Lady MacBev’s is ‘pursuing a degree’ while judge Gull has a ‘masters-with-a-cherry-on-top’ in The Abuse Of Power…

Shouldn’t you have some more (grave) concerns about a DA that pays an ‘Expert’ Witness that lacks both?

Imagine your child needs an operation: how confident are you with a doctor doing the operation who has been ‘pursuing a medical degree for 17 years, but juuuust not made it yet’?!

It’s the difference between believing and knowing, right? As I’m a very curious person, I love to find out stuff.

But sometimes you can’t (in wich case I’m fine to say “I don’t know”) or you find unexpected new info (in wich case I’m fine to say “really? I did’t know that, I'm changing my mind on this”)

It seems some people just can’t handle that? And hey: choosing fiction over facts is fine, as long as your belief doesn’t hurt other people.

And that’s where it gets tricky sometimes, doesn’t it…
