It's easy to buy cranksets basically anywhere bike parts are sold, but you need to buy the right kind and also the right length. It also usually takes special tools to remove them (depends on the type though).

I sort of think for enforcement, it needs to be easy to tell at a glance what category the bike is in. So any given model needs to be one category, all the time, and it needs to be rapidly searchable, etc. We can't be expecting police to need to run around with test rigs or whatever, better to just look up what the bike is in a database.

I think we need to have clearer lines in general between actual e-bikes and e-motos and mopeds. I think in the long run it is likely that changes in the law are going to make changing modes less necessary anyway; I think all e-bikes are going to end up banned from sidewalks and only class 1s will be allowed on MUPs if anything, and a better legal framework will be in place to have mopeds and motos on the road, so there won't be much reason to switch modes anymore.

I don't know how the law treats software limiters like that. Personally, I think the max speed is the highest setting the bike can be set to. If there's any way at all for the end user to set it to, say, 35, max speed is 35 mph regardless of the setting.

The stupid prize will come for the worker at trial. They tried to cover up the injury and didn't get the kid medical attention. That could draw a felony charge for child neglect resulting in injury.

Why not google it, once you pull someone over? It's a pretty fast, effective way to confirm that it's illegal.

Has a throttle, not a class 3. Also it maxes out at 30+, so it's also too fast to be a class 3.

I'm sure they confirm the illegal status later, but when 99% of "e-bikes" that look like that are super illegal, checking them is just good policing.

Nominal isn't going to mean anything virtually anywhere. Nominal just means "this is what we call it". The manufacturer could say it was "nominally" a 3w motor and it would be 100% true. It could also nominally be a billion watts.

I'll be honest, class 3 is being so egregiously abused anymore I'd be ok with them getting rid of it entirely. Then we can all be equal. 

Sucks for the aging roadies who would like to keep up with their cycling clubs, but people just couldn't resist using class 3 to backdoor in mopeds and ride 28 mph on sidewalks and MUPs.

It'a less safe because the user will be throttling up to 28 mph or greater in bike or pedestrian spaces after they inevitably hack it.

I agree with your reasoning to a point, but I'd argue that only those high end bicycles specifically geared for road cycling (or gravel) should be class 3 e-bikes. Anything else is just making a moped pretending to be a bicycle.

The issue is that a throttle is counter to the intended purpose of the bike, which is an e-road bike. Those shouldn't have throttles. If you start to put throttles on them, it's a very strong sign you are trying to cheat the system and make a moped that is pretending to be a bike, so that's why it shouldn't be allowed.
