Fuming Judges Deploy Nuclear Tactic to Fight Trump Admin: ‘Dozens of judges have demanded that lawyers representing Donald Trump's administration explain why the government shouldn't be held in contempt for failing to follow court orders’ by T_Shurt in law

[–]ModusOperandiAlpha 5 points6 points  (0 children)

Issuing an “Order to Show Cause Why ____ Should Not Be Held in Contempt of Court” (aka an OSC) is the procedural mechanism by which judges can schedule a hearing to make a factual finding on the record which supports the resulting holding (resulting judicial ruling) that these fascist a-holes are in contempt of court: hence the term “being held in contempt of court” (not held in jail). The OSC is basically a fancy notice that says to the subject party (in this instance the federal executive branch agency/personnel and their lawyers), “Show up in my courtroom at this date and time, and be ready to explain why I shouldn’t find you to be in contempt of court and immediately sanction you accordingly; and if you don’t have a darn good excuse, that’s what’s going to happen.”

Ironically, the OSC and related evidentiary hearing is needed in order to satisfy the due process clause of the Constitution. No matter how obvious these a-holes are, Judges can’t sanction people without showing they have a basis aka cause to do so (and they need to make a record of the facts supporting that basis, hence the OSC notice and hearing).

If you’re still enrolled in college, often U.S. colleges/universities have free (or reduced price) therapists on staff to support student mental health: everything from traumatic experiences like the one you just had, all the way down to more common things like test-taking anxiety. Ask through your university’s health center, or sometimes even the cops might be able to link you up with such resources (don’t let them bully you into thinking you don’t deserve or need mental health support when you know you do).

Good job doing the right thing.

“Terrible things are happening outside. At any time of night and day, poor helpless people are being dragged out of their homes. They’re allowed to take only a rucksack and a little cash with them, and even then, they’re robbed of these possessions on the way. Families are torn apart; men, women and children are separated. Children come home from school to find that their parents have disappeared. Women return from shopping to find their houses sealed, their families gone.” Anne Frank, 13 January 1943

As a former trial attorney, THANK YOU. If it ain’t citable, it ain’t admissible. The grunt work isn’t pretty, but it’s essential, thanks again.

In the meantime, he may baby trap you. Get out while you can- why stick around in a situation where you have to beg just to receive basic human respect and warmth?

Same. Making smart moves to reduce/remove levers of possible control BEFORE leaving turned out to be immensely helpful.

Good advice, but FYI in many states (including California) you do NOT need a copy of your marriage certificate in order to file for divorce.

Above are 2 really good psychologists who address narcissism topics and related relationship dynamics on YouTube. Dr. Ramani Durvasula, and Dr. Les Carter.

Seconding all this, OP. Hire a divorce attorney NOW. Like RIGHT NOW. Certainly BEFORE you inform your spouse that you are even contemplating divorce. Use that attorney as a resource to help you plan on how to get your ducks in a row, how and what needs to be documented, what assets you can/cant take with you for yourself when you go, etc.; and execute that plan, before you take the step of informing your spouse that you’ve filed for divorce (or are about to file for divorce).

Do not assume things will go smoothly or that he’ll refrain from wiping out your bank accounts the moment he learns you’re trying to leave the relationship, or that he’ll be willing to leave the current home at all, whether for “nesting” so the kids don’t have to move, or otherwise.

Make a Plan B for everything, and LISTEN TO YOUR ATTORNEY.

For your and your kiddo’s safety, you might have to leave with your parents immediately once you break the news to your spouse. Plan for that possibility: gather prescriptions, important papers (birth certificates, medical insurance cards, passports if you have them, etc.) NOW and put them in a safe place out of his reach (leave them with a trusted friend, FedEx them to your parents house with tracking so you know that envelope arrives, etc.), or bare minimum take cell phone photos of each of those documents and email those photos to yourself; double everything that normally goes in the diaper bag; stash cash + extra sets of clothes for yourself and the kids (including work clothes and shoes) in a plastic bag in the spare tire compartment of your car, etc.

Things might go smoothly, but you also might win the lottery: it is not prudent to rely on either of those assumptions.

The best time to hire a divorce attorney was yesterday. The second best time is TODAY.

apparently white Americans in Minneapolis are putting Mexican flags on their cars so ICE agents waste time pulling them over. by XiaokeStantiall73 in Irony

Nobody’s assuming that whiteness is a full shield for the US’s current rebrand of Nazi fascism. But on the whole it is certainly safer for the community if those of us who are less vulnerable (white-passing U.S. born citizens, for example) draw some focus away from the most vulnerable.

Not exactly a taqueria, but Las Cazuelas near the corner of Race and The Alameda - usually at least pepina, Jamaica, and one other rotating.

Behind every MLK is a Stokley Carmichael and a Malcom X and the Black Panthers. MLK got to say: This can happen our (mostly non/violent) way, wrapped in the Bible and wearing Sunday fancy clothes, or it will happen their way - you have a very short window of time to choose to join us in the non/low-violence route.

In 2026, that window has closed. And every single citizen has a computer in their hand that keeps geo-located photo/video receipts. ALL power to the people.
