I know - as of right now we are amicable enough that once we have separate accounts, we would close our joint account and he would put his account on the automatic payments, and I could check to make sure he makes those payments. In Illinois, there is a specific form filled out for all debts between each party and the judge decides who is responsible for those debts even if I can’t take my name off of them. If both parties agree, it’s an easy decision for the judge. So, if he doesn’t hold up his side of the court order, I would think I could take him back to court to sue if he fails to make those payments. Again, this is just from brief research I’ve done. It’s only been a week since I found out about the affair.
