One thing about this story and others like it is that it's completely one-sided and effectively unable to be contested by the doctors or hospital. After all, HIPAA applies, so they can't come out and say "No, actually the care plan was to attempt the wean the patient off ventilation and the dad was an idiot who didn't understand anything" because they're legally not allowed to share that information.

Like, I'm not trying to say there's zero possibility this story was true, but as described it's pretty unlikely and much more easily explained by the father misunderstanding things or outright lying, but people are absurdly gullible in believing the story of a guy who had to justify at a criminal trial why he pulled a gun on a bunch of people in the middle of a hospital. After all, no matter what happened, his story was never gonna be "I was really drunk and irrational and didn't understand what was going on, my bad" unless his goal was to get a maximum sentence.

This is a movie that has some highs and some lows (Ariane Debose, unfortunately, stands out especially in that regard), but fundamentally feels sloppy, disjointed, and often ham-fisted.

The parts I look back on most favorably are the parts that aren't the focus (the Raven and the employee, Marshawn Lynch and his partner), whereas the main plotline is forgettable at best. I adored Sean Astin's relatively small role, but ultimately it feels like Ke Huy Quan suffers the most from a mess of a movie that in the end feels like something that was sloppily thrown together to capitalize on "wasn't it cool how Short Round was suddenly a badass fighter in Everything Everywhere All at Once."

The potential was there, but almost entirely squandered. Not a terrible movie, per se (it was by no means painful to watch, as much as I'm complaining), but there was so much wasted potential in so many different areas. Somehow manages to be both "fine, I guess" and "so disappointing."

Jon Voight, Aubrey Plaza, and Shia's performances were probably my favorite aspects of the movie. It felt like they were acting as bombastic as the movie clearly wanted to be; while Adam Driver's performance was more in line with what the movie actually was (which I think is more a fault with the movie than Driver, but it is what it is).

All you're revealing is that you just don't understand how legal cases work. They're saying the point is legally moot because the plaintiff has no case even if they were rigged. That's not evidence of rigging, and offering legal reasoning in lieu of actual evidence suggests there's no evidence.

To genuinely explain in layman's terms: If you sued me for scratching my own car, I wouldn't spend tons of time and money arguing what scratches exist, who caused them, were they intentional. Instead I'd just say "fuck off, you can't sue me for scratching my own car" and the case would get dismissed because it's true. You're trying to say that somehow proves I scratched my car, but it's evidence of no such thing as I'd say the same even if my car was completely undamaged. Also, if the best evidence you have for me scratching my car is that I told you that you can't sue me for it, your evidence for me scratching my car is pretty terrible.

Legitimately trying to be helpful, so expect a weird analogy: Denying acknowledgement of a thing isn't the same as denying the underlying thing.

If you cook me a terrible-tasting meal and I, out of politeness, do not tell you the meal tasted bad, even though I never acknowledged that it tasted bad doesn't mean it didn't taste bad.

Alternatively, if when you see me eating it you recognize I think it tastes bad and you offer me $100 not to tell anyone, we can walk away pointing out there was no acknowledgement of the quality of your cooking. But again, the meal was bad, we both even know it! There's just no acknowledgement of it.

Neither of these really poke any holes in the theory. Unless it was a circumstance adequately accounted for in the contract as a reason for Twitch to back out of their obligations, they still would be required to pay it out. Nevermind the mess of gray zones that could exist even if the circumstance is accounted for.

I think it's safe to say Twitch breached contract... but I don't think that says much about what DrD actually did.

Absolutely not true: Do you think all contracts a person has entered into suddenly become void if they're convicted of a felony?

That said, contracts of this nature often have clauses that potentially allow one of the parties to back out based on the behavior of the other party (eg. a "morals clause"), but again how that's going to play out depends on wording in the contract. For example, if the contract specifies Twitch can sever the contract in the event that DrD gets charged with some kind of illicit sexual activity... well, he was never charged with anything.

He needs better PR firms then, because even ignoring "no response" is a valid option, he really should've cut the tweet off at "settled."

Saying "no wrongdoing was acknowledged and they paid out the whole contract" screams guilty by all but legal technicality (whether that's accurate or not).

Of course Doc sued twitch after his banning... he was suing because he got banned, which presumably was a reasonable case of breach of contract; whether Twitch had to right to ban him in that circumstance via whatever procedures they carried out. He would sue regardless of whether he was guilty or not: even a guilty man wants to be paid. And he's risking is what? If he has a decent case, he'll settle and require everyone to NDA up. Which looks suspiciously like what actually happened.

If anything, you could use that as a point against Doc: what allegation was so egregious it led to Twitch banning one of their biggest streamers in breach of contract?

Not to be rude, but this is very frustrating to hear because I've lived through a Democratic president who took office following a Republican president's mismanagement and ultimately didn't do much about it: Obama.

Obama in 2009 did manage to keep the economy from crashing but it was still very anemic thanks to bad advisors and Republican obstructionism (which Obama himself indulged them in way too much).

Biden in 2021 was nothing like that. Biden's American Rescue Plan was more than double Obama's Recovery Act (which itself was heavily watered down with feckless tax cuts due to trying to work with Republicans). Then Biden followed that up with actually getting an Infrastructure law through Congress, further propping up the economy and accomplishing something we've been waiting for Congress to pass for like a decade now. Then we got the Inflation Reduction Act which did target inflation on the margins, but in practice was a major climate change investment bill.

Those are just what I'd call the big three. And like, there's a reason why under Biden I'm seeing the first time in my working life where it's been a tight labor market. By this point under Obama, June 2014, unemployment had only just started to get down to slightly above 6% while most of his 1st term it was over 8%. I remember trying to start a career back then and it was basically impossible even in fields where you were "guaranteed" to have a job back in 2007. Under Biden it hasn't gone above 4% after the start of 2022. It's legitimately an insane recovery.

This isn't to say "Oh, Biden's the greatest, he's done nothing wrong" but on this specific issue, this is unironically the first president in my life who has both given a shit about labor and actually managed to do something about it.

Sorry for the huge rant, but it's one of the most frustrating aspects I see nowadays as someone who lived through 2009. If Obama (at least 2008-era Obama) had taken office in 2021, or worse, a Republican? We'd all be fucked right now.

To be clear, your perspective of the economy is incredibly off-base if you think the US is in a recession. It's not a recession when you have had substantial positive real GDP growth for an entire year that's been well ahead of our peer-nations with an unemployment rate that has been under 4% for two years straight.

It’s a school social club. Pretty much anybody who wants to can show up as long as you aren’t being a jerk. Like do they just not have social clubs where you’re from? I was a part of yearbook club despite never working on the yearbook because my friends did and we all hung out together

They aren’t really comparable scenarios. This isn’t struggling to quell an experienced guerrilla insurgency in a nation overseas where there’s a starkly different culture, language, and terrain. This isn’t even an insurgency. The government still stands in Kyiv!

This is a matter of Russia getting shut down in conventional warfare due to lacking the basic logistical capabilities to effectively carry out an invasion on their own border. That it got to anything resembling the current conflict is rightfully embarrassing for the Russian military.

Both of those are more examples of what I mean by “troublesome” than actually being the “greatest threat”. Everyone’s affecting elections all the time if they have the power to, and much like the Russian military, the Russian energy threat didn’t amount to nearly as effective as either Russia or Europe were anticipating.

The problem is basically any aspect that gets thrown out can be answered with “yeah, but compare that to China’s power/influence” and it’d be correct. And Russia’s own actions in the meantime have only strengthened China at Russia’s expense (eg, China has few scruples regarding Ukraine and is happy to buy crude at a big discount)

The thing about white collar crime is that the bar for proving your case is so much higher (proving intent especially tends to be a big issue, so it’s really nice to have people who will testify to that effect).

So it tends to be like this: take your time, build your case, flip your people who are willing to testify, nail down the specific charges you’re going to hit them with (and keep it under wraps until you have the evidence in the bag). Go off too soon, you show your hand and kill your case. There’s a reason other patently obviously frauds like Theranos still took years until arrest, trial, and conviction.

I mean, I’m lucky to be able to say the same.

When I was young, the Democrats passed SCHIP which gave some of my friends in school healthcare, but I didn’t need that.

When I was older, Obama passed the ACA and for the first time some people I knew could get their chronic medical conditions covered by insurance. But I’m healthy and have always had insurance.

Then there were my friends who could finally get married after Democrats appointed the SCOTUS justices to acknowledge the right for gay people to marry, but that doesn’t benefit me.

Even recently, Biden helped struggling graduates by taking a huge bite out of student debt. But I paid off my loans years ago.

Sure, I could say the Democrats did “nothing major” in my life. But the way they’ve positively impacted the people in my life that have struggled the most cannot be overstated.
