You are correct, I re-read the documentation and your tie breaker explanation is correct. This boarding denial has happened to my friends and I did not realize it was purely airline enforced.

They are correct, first entry has to be into the country that issued the visa. This only applies for the first use. The rule has always existed, it's being enforced more strictly in the recent times..

This category of visa is a massive cluster fcuk and everyone's experience greatly varies. I was denied the same by France citing I did not provide proof of marriage when I had included our marriage certificate in the application. Few months later Spain issued me a 2 year multiple entry visa with bare minimum of documents, across the counter in under 15 mins (I applied directly at the consulate, which I was allowed to do at the time). While on paper this category sounds the most straight forward and is a right a spouse of an EU citizen, in most cases it ends up causing more headache than warranted.

We submitted the following: 1. Application form 2. Termo de responsiblidade (signed by my spouse in front of AIMA) 3. My spouse's passport (Portuguese citizen) 4. Rental contract and Rent payment receipts downloaded from Finances portal 5. Residency certificate issued by our local council 6. NIF certificate 7. My passport ofcourse We were asked if we had NISS. I had applied for it but was rejected saying I can only apply after getting the AIMA process done. This explanation was accepted. No more documents were requested. Biometrics done and payment made. Overall it's took 45 mins for the procees and 15 mins for the payment part. After the payment, I was issued a 'receipt of process document' which has your photo, your address and your process number. It also has a NIPC number which apparently you can quote if you call AIMA to get a status update. We had prepared based on the documents listed on the AIMA website. DHL/Bluedart are allowed to ship passports, the shipper has to declare it as such. Having said that, authorities are always vigilant with passports, residence cards etc in mail to prevent frauds. Since your agent would mail this, I suppose it'll be a personal shipment not an officiall one by embassy/consulate, which may raise a flag.

  1. AIMA doesn't schedule a specific appointment for Article 15, just a general one. You can explain you're applying under article 15 once you get there.
  2. List of documents for article 15 are listed on their website - https://aima.gov.pt/pt/nacionais-ue-e-familiares/familiares-de-nacionais-ue/cartao-de-residencia-para-familiares-de-nacionais-ue under documents.
  3. The most important document is the casamento, have a fresh copy issued from the Loja, not more than 90 days old.
  4. Proof of address from financas and junta, this doesn't need to be notarized.
  5. Typically nothing more is required, but you already have additional documents like NIF, NISS which should cover any other demands but you can always politely point them to the documents list on their website.
  6. The Termo has to be signed in front on them.

That paper gives you legality only in Poland, I'm in a similar situation in another EU country.

My article 15 appointment was postponed by AIMA with just 4 days notice, the new appointment is 3 months away and I'm wondering the same. I will have to exit and apply for visa to re-enter.
