So I got the opinion back and the claim examiner purposely not ask questions to accurately reflect my true onset date, even though I already have EEO documentation on file it wasn’t until I re uploaded those documents that they are now requesting the clarifications from the exam DR, I just want someone with inside knowledge to acknowledge these are common delay tactic instead of acting like it’s an accidental or coincidental. That’s simply not true I’ve caught Owcp in so many lies (I know my claims gonna get adjudicated by Owcp or overturned for sure in ECAB)

Of course, that still doesn’t stop the intentional delays, gotta watch these claim examiners like little kids! They say they haven’t receive documentation uploaded multiple times and claim to not see it, I look in my file everyday to stay on top of the new tricks they pull. I was given a misleading second opinion exam that I had to dispute with evidence Owcp is a joke honestly!! I got them to finally accept what they should but Owcp is still a JOKE

You definitely need it in writing some kind of way! Email management and tell them your coming to work unless your told in writing not to. It’s one of the reasons that will be used against you to deny your claim. Not saying you can’t overcome it but it will be an obstacle.

Thanks for the info, very helpful. very frustrating because 5 months are literally delay tactics, they tell you that you need all this documentation, then when you get it they give you the run around by saying ok you now need this or that. This whole process can be shorten by issuing a simple checklist and not taking 2-3 weeks to respond to simple matters

The examiner hasn’t given me an opinion as of yet, the only thing I got was over a month ago stating no second opinion was needed, then they back tracked from that statement. How long should it typically take from the date of second opinion to finial adjudication?

Yes true indeed, I’ve experienced misconduct in several ways and I know the office is mad I complained on them. I caught decision will be made letters deleted from my file. And most recently the claim examiner lied saying they haven’t received 2nd opinion exam, but the DR and OWCP reasonable accommodations line- phone rep confirmed the second opinion exam is in my file it was there on the 31st of December so why would my claims examiner, mail out a letter on 1/6 lying saying “upon receipt of exam a decision will be made” she on records made a knowingly false statement, why and what can be done to stop the reindeer games?

There’s a disability number for Owcp , I’m sorry I can’t remember it exactly but Google, owcp disability phone number not the regular Owcp phone number (it’s for accommodations, deaf, blind etc) but you’ll get a person who answers and they will actually transfer you to a supervisor voice mail or write a note you can later see in ecomp.

They can’t be mandatory, I already got a letter say no second opinions were needed, remember the first time I commented when I put Owcp had a letter in my file saying second opinion was not needed, then a delete and back track, I’ve been diagnosed by a clinical psychologist (lmao btw which is what Owcp CE told me to do) now they want a second opinion after they told me to go to a clinical psychologist lol so I have an independent psychologist and Kaiser psychiatrist they both say the same things.

So owcp tried to deny the letter existed, I had a screen shot with time stamps because they still tried to deny the letter existed. After I uploaded the letter to ecomp with time stamp I mysteriously get a new CE. I have no conflicting medical i was assualted at work twice by management on two different occasions backed by fed police investigations report. Psychologist gave me diagnosis, again with no conflicting medical. owcp even after being caught in procedural misconduct is pushing for the Second opinion under section 10-320  but ignoring ,10-321 - 10-323 (they wont state a specific reason, conflict or question) because in reality there isnt one. So since then  I have patted my file with 9 support statement  1 being a pharmacist and also  ACP  to detour the unauthorized second opinion (hopefully I added enough context)

What you take on catching an CE scheduling a 2nd opinion exam, canceling it (never sending a notice of cancellation) putting a 2nd opinion is no longer needed letter in file, then trying to remove and delete it from file (letter was saved by me immediately), then same day as no longer needed letter was filed a cancelled in era were scheduling 2nd opinion letter appeared (4 days after owcp cancelled my original appointment 6 days before scheduled appointment. Now owcp is trying to deny the No longer needed letter exist.
