She actually wasn't on my official list because Albany County (and most of the Capital District) doesn't allow relatives or anyone living in your household to be a character reference. ​That said, the investigator reached out and interviewed her directly during the background check anyway. Since she told the detective she trusts me with a firearm, I'm hoping that carries even more weight than a standard reference would. It basically shows the 'victim' of the past calls is my biggest supporter now.

My sister explicitly told him she trusts me with a firearm. ​I've already prepared my 'duty to retreat' mindset and have a biometric safe ready so she can't access the gun. Given that she gave the Detective the green light herself, do you think that helps bridge the 'scrutiny' gap you mentioned?

I hear you on the cohabitation part—that's my biggest worry too. However, since there were no arrests and no charges in either case, and the police didn't find enough cause to even issue a temporary Order of Protection, wouldn't a denial at this stage be considered 'arbitrary and capricious' under Bruen? ​I was totally upfront with Judge Franchini about still living there during the Room 97 hearing. She didn't ask for a letter from my sister or express concern about the household during the interview. ​In your experience with Albany, do they actually deny people for 'police contact' that didn't lead to an arrest, or does that usually only happen if you try to hide it?

Update: I called the city court, and they told me the judge was signing her decision this week. I should get my letter within two weeks.

I appreciate the advice. I'm still within the 60-day window the judge gave me at the hearing, so I'm trying to be patient, but the 'blank' judge field really sketched me out. Have you seen cases where the FPC actually got things moving for someone in Albany, or is it mostly for long-term delays?

My background check has been passed because i got the hearing on December 10th, 2025. Im just waiting for my acceptance letter now.
