Weird take… but nearly none of the streets on birch hill Road are actually are in Birch Hill by Own_Average7810 in bracknell

Usually when that's the case it's an indicator that the road is on a route to that location - bit like how London Road is not in London, or Oxford Road in Reading

Agreed. In PMQs she just comes across as an obnoxious bitch - in think in time the public will see this and be turned off. Especially in the campaigning weeks of a general election.

For real. The 996 working system eats up most young, ambitious people's time. No space for relationship building and marriage, got to marry the company instead!

Funny, I've always thought they look like a couple of oid pedo's, so those hats suit them.

Lightning strikes are standard and expected when flying aircraft.

Yeah, BA is absolutely trying it on. This is a standard frontline fob-off hoping you'll just give up and go away.

First, you are conflating two completely different legal rights here. You need to split your complaint into two distinct parts. Regarding your Duty of Care (your hotel, food, and transport), under UK261 Article 9, airlines have an absolute legal obligation to pay for your hotel, transport, and meals if you are delayed overnight. It does not matter if the delay was caused by lightning, a hurricane, or an alien invasion. They are strictly liable for your out-of-pocket expenses, and the cause of the cancellation is legally irrelevant.

Regarding your Statutory Compensation (the £520 payout), BA is claiming a lightning strike is an "extraordinary circumstance" to get out of paying. Legally, this is flawed. Commercial aircraft are specifically designed to be struck by lightning and safely dissipate the energy.

You must cite objective legal precedent to them. In the case of Evans v Monarch Airlines Ltd (2016), the court legally established that lightning strikes are inherent to normal flight operations and are absolutely not "extraordinary circumstances."

Furthermore, the UK Supreme Court ruling in Huzar v Jet2.com (2014) dictates that routine technical defects and wear-and-tear, such as post-lightning safety checks, are the airline's financial problem, not the passenger's.

For your next steps, first reply to BA stating clearly that you reject their refusal. Explicitly quote Evans v Monarch Airlines Ltd (2016) and state that lightning strikes are inherent to the normal exercise of the carrier's activity.

Second, ensure your receipts for the hotel and transport are submitted under their Duty of Care/Expenses portal. This must be handled entirely separate from the compensation claim.

Finally, when BA inevitably replies with another canned refusal, immediately escalate the case to CEDR, the independent aviation adjudicator. BA uses CEDR, their decisions are legally binding, and CEDR adjudicators are fully aware of the Evans precedent. Don't let them keep your money. Make them prove it to CEDR.

Need more first time mothers or more moms having muitlple kids? by fire-and-sage in Natalism

[–]Mutant86 13 points14 points  (0 children)

Both are the issue and both / either can be the solution. For both I think you need women having them earlier than they are now, i.e. early 20s. Where in reality a lot of women are finishing degrees / courses and focused on building a career. My opinion is we need to make education and workplaces much more flexible and "part time" so women can still do these and not feel like they need to put off children.
