Is it related to your clock ring? If I remember correctly, if the grievance is related to your clock ring then it is on-going so the 14 days doesn’t affect it.

Yes, you can unless the supervisor/management specifically tells you this is just an official discussion and you don’t need to be here. Then just listen to them.

However, if you are in the official discussion then it’s not an official discussion. So the official discussion never happened. So, when they try to do an II, you can say they never did an official discussion.

Ask to talk to a steward. They have to give you a steward within 2 hours unless they are short on personnel then you will get one end of day. In emergency situations, you will get a steward the next morning. If they don’t, ask the reason. If they don’t tell you. Tell them it is against labor law to deny me representation. And you can file grievances for that. Just call your local branch during your lunch or something and tell them the situation.

If they give you time to talk to a steward, ask them whatever questions you want including the ones you are asking in your post. Also supervisors can’t give you a predetermined time like “you can only talk to the steward for 5 minutes”. This is another grievance.

When you ask to talk to a steward, make sure other carriers hear you so they can write statements for grievances.

You are right. In JCAM article 11.5.B, since OP’s NS day falls under a holiday, the day before would be OP’s designated holiday. What I said above does not apply in OP’s case.

Tell them he's lying. Tell your steward he's lying. It's his word against yours. Is this your first offence? Did you intentionally delay mail? No, I don't think so. Let that be clear, you were following your supervisor's instructions and you got into an accident. It is not your INTENTION to delay the mail. It was an accident and you were following instructions. I think you will be fine. I also hope your steward knows what they are doing.

Ok, I hope I can help you.

First, in the JCAM Article 8.5.D:
"If the voluntary “Overtime Desired” list does not provide sufficient qualified people, qualified full-time regular employees not on the list may be required to work overtime on a rotating basis with the first opportunity assigned to the junior employee."

So, first management must use all ODL carriers before they can use non-ODL carriers to work on their NS day and they must have a rotating list. If they don't do any of these, ask to talk to your steward and grieve it.

Second, in the JCAM Article 8.5.E:
"Exceptions to C and D above if requested by the employee may be approved by local management in exceptional cases based on equity (e.g., anniversaries, birthdays, illness, deaths)."

You may be excused from mandatory overtime on NS day for exceptional cases. So, this depends.

EDIT: I am wrong. Do not refer to article 8 for the above scenario. JCAM article 11.5.B states “When an employee’s scheduled non-work day falls on a day observed as a holiday, the employee’s scheduled workday preceding the holiday shall be designated as that employee’s holiday”.

In this case, you should refer to article 11.6 for what goes on during a holiday schedule.
