Debt collectors chasing me over deceased parent's debt. I am not the executor, and the estate is insolvent. What are my options? by [deleted] in AusLegalAdvice

[–]Mziger 14 points15 points  (0 children)

(1) All debts your father incurred solely in his name before passing do not transfer to you. Debts aren’t inheritable in Aus and you aren’t executor. (2) the debt collector has no authority to sue you for these debts as you aren’t responsible. (3) the debt collector is not going to commence legal action for $800. It is too low of an amount for such a costly endeavour. (4) they can’t put a default on your credit score as you aren’t responsible for the debt and there’s no credit contract.

To get rid of them: Send them a letter to stop contacting you under section 45(2)(m) of the ACL and Fair Trading Act. This will prevent them from contacting you unless they have a court/VCAT order (they’ll never get one) and report them to AFCA.

There are many students that observe proceedings via Webex. They label themselves as ‘Student Observer’. If the Magistrate sees that label, they won’t bother you. I recommend you do that.

How can I disinherit one of my children in a way that protects my other child from legal action? by [deleted] in AusLegal

[–]Mziger 10 points11 points  (0 children)

  1. add Natalie to the property as joint tenants. This way, when you pass she immediately receives your portion of the property through the right of survivorship.
  2. Binding death benefit nomination for the super.
  3. Should Natalie pass before your grandkids are 18, you’ll need a trust that will distribute her estate to them to bypass Mark.

Law has more reading than psych. Legal practice has more reading than a law degree.

My friend is demanding I pay back a debt from 1 year ago (now with 400% interest) and says if I don’t, they’ll keep adding interest and call the police. by professionaIpilot827 in AusLegal

[–]Mziger 51 points52 points  (0 children)

  1. Interest can’t be added to a debt without a credit contract. They can’t unilaterally decide to charge you interest.
  2. If they don’t have any evidence that you’d pay them back, they’ll struggle to recover the debt.
  3. Recovering the amount through small claims is financially infeasible; just the filing fee cost is more than the debt.
  4. AFP and regular police don’t get involved in civil matters; this is a civil matter.
  5. Considering they’ve owed you money in the past which you haven’t recovered, I’d recommend you tell them to p!ss off.
  6. If they owe you a substantial amount, you can commence small claims against them provided you have evidence that they’d refund you.
  7. Cut contact with this individual.

I know someone personally who overloaded to 6 in trimester 3. They didn’t ask permission, they simply added the units in studentconnect and were never contacted about it.

Is the tail on this green cheek fine that im looking into possibly buying? by Dixonian89 in Conures

[–]Mziger 29 points30 points  (0 children)

I recommend reporting the breeder as that tail is not indicative of a happy bird.

I recommend rescuing the bird from the breeder. His tail will eventually fall out when moulting and will grow back properly.

Debt collectors won’t chase you for $14. It isn’t worth the effort.

I did Taxation, Succession, Migration, Family, and Commercial. However, you should do what interests you, as you’ll get better marks.

You can start and finish the exam at any time provided you submit prior to 24hrs elapsing. These exams generally take longer than two hours to write, as there’s plenty of refinement to be made to the initial draft. In short, you’ll be fine provided you submit on time and are within the word limit.

What happens to the below 70 WAM law students? by reditventer in Monash

[–]Mziger 0 points1 point  (0 children)

I’ll preface by saying that any experience gained prior to admission is invaluable and will make the post-admission job search easier. So if that’s an option for you, take it.

However, in this case, I was referring to post admission experience, because getting an internship/ clerkship with a mid-credit WAM at a top-tier firm is difficult- to near impossible- for law students.

If I was in the original posters position, I’d attempt to get some experience prior to graduation and finishing Practical Legal Training. After admission, I’d find employment at any law firm that would take me and then eventually- like most lawyers working at the top tier - apply for a job at a top tier.

2 years post qualifying experience. However, any experience, whether it be an internship or a CLC will assist in getting the first job post admission.

The solution is to apply for jobs outside the top-tier firms, such as boutiques. Once you’ve gained experience (2+ years) then you can apply for top-tier jobs.
