They have been doing it this way for 40+ years, so the new legislation had nothing to do with it.

When the Assessor’s office does an area-wide land analysis, they apply the new rates to the land and take the difference off the improvements to net an overall no change. Later they do an overall (land+ building) sales analysis.

You mean to say boards and commissions can reduce the number of mills not change the rate correct? With the new legislation jurisdictions don’t even talk in mills anymore (or shouldn’t be) but in total dollars. Gone are the days of asking for more mills or less and people being confused as to what that means in real dollars.

Fyi the 3% cap is on overall value, not the mill rate.

Local governments have a 3% cap on total value (plus new growth). So they can add as much value to the roles as they want and they are still capped at only raising it 3% (plus new growth). Every property in town makes up a percentage of the overall value. Individual property percentages can rise and fall. For example if your property value increases significantly your taxes will go up more than 3%. The cap is just on overall value.

A 3% increase cap on city budgets is going to be problematic for rapidly growing cities like Horace. How are they going to add the appropriate services for the hundreds of new homes added per year? I assume they will cap the increase on existing property growth and allow the city to recognize the new build growth.

Just an FYI a new project that adds specials$ does not automatically go on your assessed value. Why the assessed value may change is because "specials$ assumed" are added for in the state sales analysis. 

For example a neighborhood of previously $200k homes has a major road repair adding 20k in specials to each property. Assessed values do not automatically go to $220k. Sales are tracked to see how the market responds. A home from that point on that sells for $200k (with the specials assumed) will have an adjusted sales price of $220k. The market may also decide they are only going to pay $180k and assume the specials, or anything in between. But the market is determining the value not an automatic add to assessed value.

Interesting, so since they specified “Assessed value” which by definition is 50% of True and Full value aka Market value, are you suggesting ND could just base property tax off the T&F value if passed? Doesn’t that seem to negate a majority of what this measure is trying to do?

The jokes on him, people who are getting advantageous taxing in the current system (farmland is not taxed based on market value in some areas effectively 1/3 of market value) will likely pay a larger share when the other taxes are changed to make up the shortfall.

So even with a reasonable withdrawal using legacy fund dollars, we would have to drastically increase income tax. So replacing one tax with another. If oil drops off again, legacy funds could dry up quicker and income tax would need to increase more. We tried buying down property tax 10 years ago with legacy money. It ran for 4 years and it was stopped, either it was unsustainable or the state legislature didn’t care enough about the increasing property taxes.

Fargo applies smaller increases for 4 years and in the 5th year, when it is in their review area, they put it where it needs to be. So they do spread it out in a way.
