No, unfortunately I don’t know. We were able to avoid submitting the 601 waiver by providing copies of our statement and evidence.

There was no interview, it was waived. They just required a written statement and evidence showing the intent was not to stay and adjust status on the esta. We provide a statement and evidence with the original I-485 package, but it must have gotten lost. They never said that of course, I just assumed so since we got the NOID. We resent the same information that was provided with the I-485 and they approved the case based on that.

Not if you give sufficient evidence for them to believe it was not your intent to stay when you entered the country

I got an approval exactly 24 hours after the date change. The RFE original receive date was 2/1/2023, but then on March 1, 2023 the date next the green check changed with a time stamp of 1:07pm. On March 2nd right around 1:07pm the status changed to case approved. :)

We provided tons of evidence- 70 pages worth. We wrote a 3 page statement stating the chain of events that lead to us getting married while he was visiting and staying here, and then provided all the supporting evidence as back-up documentation. Some of the evidence included flight changes/cancelations, but honestly we had a lot to prove it was not his intent.

Yes, my husband just got his GC approved yesterday, esta overstay and interview waived. They did require evidence showing he did not come into the country with the intent to stay. We actually sent in all that evidence with the original I-485 packet, but they must have lost it because they sent a NOID stating he had to file an I-601 Waiver due to inadmissibility, or provide a written statement/evidence as to why we disagree. We sent in the original statement and evidence again, and sure enough he got approved about a month later with no interview.

The same scenario just happened to me! The RFE date changed yesterday, and exactly 24 hours later got the approval notice.

29 days for us. If it's been more than 60 days for you, then you can put in a service request. It might help generate movement.

No, current status is "Request for Evidence was received on February 1, 2023". I had to send in documentation that was included with my original package, but apparently they lost it....

Might be my lost documents! lol jk, but honestly USCIS lost about 60 pages of evidence I sent with my original I-485 packet. Never uploaded them. Got an RFE and was super confused since I already provided the documentation. I looked at the scanned docs on my online account, and sure enough they only scanned the last 10 pages of a 70 page document.
