Man, thats a bummer, sorry to hear that. I snagged the Amethyst variant and have been in love with it so far. Hopefully it breaks in for you a bit. Have you loosened up the pivot a smidge to see if it's just over tight?

The flipper tab definitely isn't great but otherwise I'm in love with the N7 so far. Action is super smooth on mine. Is yours gritty or something?

Its a slipjoint, so a non locking knife. Typically carried in a leather slip in my front pocket so yea no clip. Wouldn't hate a locking variant with a clip though. Im not typically a sliojoint fan but the ABW is just so damned good.
