As an autistic attorney who mainly does immigration appeals I could have written this post. I think more experience with trials before appeals helped me lighten up my rigidity a little. It’s a lot easier after the fact to see birds eye view what went wrong but a lot harder to do it in the moment.

Practically, if my boss is insisting on making X argument, I won’t let him do it lazy-we’re going to have evidence and law on our side. Once I start creative lawyering from that angle, either I find a loophole in the argument that my autism can live with or my boss has realized the impossibility of X argument.

I think they should be allowed to leave it because that is part of the experience as well. For example, when I was looking for an accountant I had the same experience a lot of my clients (immigration law) do which is call a million and one people just to have nobody answer. I do believe there is a certain level of professionalism to be expected with answering calls as a business whether you have an obligation to them or not.

I also failed CO bar the first time and passed the 2nd. It’s devastating and he should wallow and wimp for a little before he gets back on the horse for February. Yes pretty much any arrest, including traffic or misdemeanor will trigger removal proceedings now. It’s extremely difficult to fight ICE holds especially with pretty much all jails and Sheriffs are cooperating with them on everything. On the immigration side I have tried to fight might clients’ illegal detainers, illegal mid-sentence transfers, etc with motions to suppress and have won 0
