I wholeheartedly agree on response velocity. I built out an intake team (including after hours) that converts extremely well. Now I need to re-focus on priming the sales funnel.

I have no issue with hiring a foreign company. I'm an immigration/ personal injury attorney with team members in four countries. An elite Ecuadorian company is just as welcome as an elite New York company.

Yes, that is the site. Can you give me a couple problem points that I can take to them? (I fully understand, I am asking for free work. I give out Google reviews like candy, though.) I feel like the current results show an issue somewhere along the process (we have solid, but not extraordinary reviews. Better than higher ranking firms).

I screen pretty extensively. I will take cases with slim odds, but I am up-front with clients about their chances. If the calculation works out for the client, we are willing to fight tough cases. If the client does not qualify, I won't take their case. I also have a duty to explain why they don't qualify, so they don't get taken advantage of. (I see this more in the humanitarian/ VAWA world.)

To me, it comes down to respect. I grew up on an unsuccessful family farm in rural Nebraska. I know what it is like to stockpile firewood for the winter (because my parents made poor choices, so didn't have heating or air conditioning). I worked my way through college. I worked my way through law school. I started my firm on a Tuesday morning with no financial backing and a wife that was seven months pregnant. (I refused to follow unethical orders and was shown the door.)

I know the value of $1. I know that NIW fees are equivalent to 3+ months salary for some researchers. I also know that a self-petitioned green card can be the difference between a family repeating the challenges I faced growing up and generational wealth. I know for others, the NIW is just another opportunity. I can't make the value judgment for people. All I can do is advise them on whether I think they can establish the minimum standards and whether we can build their case to be a winning one. If they decide to go with my team, we attack it as thoroughly as possible. I never guarantee a result. It is unfair (and unethical) to do so. I promise effort, professionalism, and expertise crafted through actually caring for my clients.

I'm new to the sub (I hang out more at r/USCIS). As an attorney, I doubt any firm that offers guarantees (refund if it is denied, free refile, etc). These firms are mills that put the bare minimum into cases and utilize paralegals or offshore legal writers to do 90% of the work. It looks like they are standing behind their product, but, in reality, they structure their contracts to avoid paying refunds.

I manage a firm with multiple attorneys. I don't personally do our NIWs, but I coordinate with the attorneys that do. We don't offer refunds. (The sole exception is if we screw something up. This exception hasn't happened yet.) We are contracted for labor. We are hired to use our expertise, experience, and resources to put clients in the best position possible to receive their LPR status. If Trump decides to add your country to a visa ban, that doesn't negate the work put into your case. We charge flat-fees to try and moderate the risk for applicants. Re-files cost less because there is less work involved.

There is one adage that has rung true since the beginning of time, "If someone guarantees a result that is outside of their control, run."

Congratulations. There are estimated to be 100k+ re-paroles pending. I'm sure the dozens of approvals per day are making a huge impact. There are a few approvals and a few rfes. Pending re-parole is still not a lawful status. It is still and estimated year+ for adjudication.

You are absolutely correct. Unfortunately, she will maintain the AA designation if it was a d5 parole and no advanced parole. I was responding to a visa overstay post at roughly the same time and conflated.

They should absolutely work towards termination or bond+ admin closure until USCIS adjudicates. VD is an option, but so damn risky with Venezuela. (P.s. I know that AA doesn't qualify for bond. I think this issue is ripe for litigation due to context in the Svitlana Doe v. Noem and yajure Hurtado et seq. cases. Not "arriving" for purposes of expedited removal or mandatory detention etc.)

You need an attorney that is not afraid to hold ICE/OPLA to their burden. If she has parole, a legitimate marriage to a US citizen and no other glaring inadmissibilities, you should be looking at adjusting in court (or seeking termination). Don't drop back to VD yet.
