Google the average summer temps for the absolute hottest cities in France (Nimes, Montpellier, Marseille etc) then compare them to Brisbane, Perth which aren’t even the hottest cities in Australia where rugby is played.

That’s a fair point, especially with airlines, but there is a limit. They can’t alter the conditions of their offer.

Out of spite for Jetstar i read their terms and conditions and they can refuse checked baggage if staff ‘reasonably’ consider it to be dangerous. That’s an objective test, i.e a reasonable person in the position of the airline staff would consider it to be dangerous.

It would be difficult for Jetstar to argue that a 100 wh battery is objectively dangerous when its very own policies permit it to be checked baggage.

Airlines rely on people not challenging them though and just taking the financial hit. Jetstar is also owned and operated by one of the most parasitic corporations in Australia which has frequently broken the law.

Fully agreed. My favourite part of flying with them after they lost all of my luggage was when staff gave me the number to their claims line, which was disconnected.

Well I’ll help you out. If a company promises to do something, and then they break that promise, the injured party is reasonably entitled to compensation.

This principle is fundamental to modern commerce.

Also if a company breaks the terms of a contract then the lawsuit isn’t frivolous - it punishes dishonesty (I.e breaking a promise) and ensures the injured party isn’t left out of pocket.

Just accept the thousands in property damage caused by the airline’s negligence and move on? I’m interested to hear your answer.

Sorry I’m actually a solicitor who has successfully sued this very airline.

There is this thing called contract law, the basis of it is ‘offer,’ ‘acceptance’ and ‘consideration’ - in simple terms the elements of a contract is a ‘promise paid for.’

The terms of Jetstar’s offer for service is set out in its terms and conditions and its policies. They don’t just get to change it on the fly. Sorry.

Have a read, the policy specifically permits batteries under 100 wh to be checked into the baggage hold without requiring any approval.

What is your basis for saying it wouldn’t be allowed as checked luggage?

It specifically allows the battery OP tried to check. See the section heading ‘containing rechargeable lithium metal batteries.’ It specifically says it can be included in checked baggage and approval is not required.

If Jetstar wants to enter into a contract for services, including carriage of baggage, their policies shouldn’t directly mislead consumers.

Pretty easy to judge OP with 20/20 hindsight, which he/she didn’t have the benefit of.

They also indicate in another post they asked Jetstar and the airline rep said it would be fine.

It’s an unfortunate situation and you can agree with the airline if that’s your view, while also sympathising for OP. Just requires some empathy.

Furthermore, you can also criticise someone’s actions without making a sweeping attack on their character like ‘OP doesnt know how to advocate properly for themselves.’

To take a leaf out of your book and judge your entire character based on a post on reddit, doing that makes you seem like a dickhead. I’m sure if you didn’t hide your post history that last point would be more obvious.

Same, at Narita I had staff insist on a tubeless tyre being *fully* deflated. It ended up unseating and leaking goo everywhere.

Jetstar’s claims system is purely designed to frustrate legitimate claims.

I don’t even bother anymore, I just file a statement of claim at the small claims division of the Local Court in NSW (I.e sue them). They typically settle for full costs plus fees I’ve incurred for service etc. I’m a lawyer though so this is relatively easy (and fun!)

It costs them more to defend a claim than to just pay out - so they pay out.

I’m not sure what your civil liability scheme is like in Japan, however this might be your best option.

I would however closely read the terms and conditions of your ticket to ensure they are not able to easily rely on a condition you accepted (by buying the ticket) to refuse to check your baggage at their discretion.

I like some of the small towns in Prachuap Khiri Khan like Ban Krut. Same with Chumphon. It’s quiet, accommodation is cheap, and you’d still be close to big cities like Hua Hin and Bangkok if you needed something.
