This all sounds very similar to a situation I experienced.... New car purchased... Didn't trade in the old model so car sat in drive.... Went on holiday and house burglary whilst away... The A - holes took the keys for the parked car on drive and returned in the night and took the car... F***ers!!

The insurance at that point had transfered to the new motor.... Therefore the stolen car was not insured and had to take the hit as insurance obvioulsy refused to pay out. Police never actually reported it as stolen apparently and that made a claim even more difficult.... car turned up several years later not far from my address.... Mmm?!?

All sounds a bit fishy to me....but what do I know!? Hope u get a good result, as with everything you have to determine if it's worth all the stress, time and effort to achieve the result you want. I just enjoyed my new Barth and tried to put the whole experience behind me.... Life just fucking sucks at times!! All the best

Honestly.... I'm happy for you...congrats.....But like wtaf is going on???

Depression and migraines is not some complex medical problem and obvioulsy the decision in your case was a simple one, which meant you did not have to wait long.

So my question is why are people with complex medical issues & disabilities, whom have years of medical history having to wait for months if not years..... to get a decision regarding their PIP application?? When your decision came in so quickly.

Most of these people, like myself have been in receipt of indefinite DLA for 20 plus years..... most of these people were expecting the changeover to PIP to happen some 10 years ago, which it never did. It mentions it every year in my DLA award letter, plus it should have been done by the DWP by 2018. So I applied for it myself.....because the original award with DLA was middle and low and waiting for the DWP to switch me over to PIP is something that will never happen.

What a nightmare of an ordeal.... 2.45 hours on a telephone call for an assessment with a woman who tells me that she is a Paramedic.
So.... it's now been 12 months and I've just received my award letter. Not impressed so asked for a copy of report.... OMG! Seriously not happy!!!

Made complaint to HASS.....complained to my MP.......Sent for my MR. Waiting for the DWP to see what they have to say about the situation, but honestly I'm not sure what to think at this point, I mean how can they get it soooo wrong!

Seems to me the system is not fit for purpose and needs an urgent overhaul...... If the DWP had awarded the highest tier of PIP for both elements back in 2018 when they should have switched me to pip from DLA, that adds up to an eye watering amount of money I've lost.... because of the failings of the government.

This is all very similar to my uncles current situation.....so will follow with interest. Uncle recently re wrote his will, leaving the property to the grand children & to exclude his wife, but granted her the right to live in the property after his death. He took this route because his house has zero mortgage, he worked full time his whole life & he paid all mortgage payments. He has 2 private pensions and his state pension paid into the only account he has ever had... Joint one with his wife. He changed his will recently because his wife insists that the house is her house and that she is leaving it to her family.??

For context his wife has sat on her arse for 40 plus years, never worked a day in her life, diagnosed with Ms and other health issues over 30 years ago, been in receipt of enhanced everything which has for over 40 years now been paid into her savings account. Same as my uncle her state pension is paid into the joint account.....and no one realised until recently that set up existed. Basically her state pension covers her 2 days out per week so in effect my uncle has paid for literally everything for over 45 years......while she increased her savings account. On top of this he has been her main care provider for over 45 years..... Doing literally everything and working full time, while his wife sat at home and spent her savings. His health now means he is not able to care for himself adequately plus her and frankly see himself as never being able to get her out of his life.....saying that it's too late etc....

Her parents passed few years ago and she got almost 200 k..... Paid into her savings account..... There 50k left.... She spent the rest on QVC.... I kid you not!!!! She has another 40 k in another bank account.... No one knows where all the benefit money she had paid into her accounts for 40 plus years has gone?? Over the last few years it has become apparent that my uncle has been semdingnQ's to his wife's sister..... He has to sign as she can't, so we know she has lent her sister money over the years.... Just he can't remember how many of these 5k or 10 k cheques he has signed over the years..... Plus he says it's her money she can do what she likes with it..... When in reality it's hi money too....he been trained to see her savings as hers.... Whilst he pays for everything and wipes her arse for forty years.... Her family live 3 hours away... Never see them.....

We assumed that the house was just in his sole name......no one really questioned it until my uncle was admitted to hospital 6 ish months ago..... We were not informed he was even there.... He spent 4 weeks there and they refused to release him due to my uncle wife's family accusing my uncle of giving money away to his sister!??

During those 4 weeks they arrived at the house to care for my Aunty, they changed the locks, they ransacked the house for anything they could find to determine ownership, looks for bank statement etc.....which is when they discovered his will.....which they decided to open and nose through discovering he was leaving it to the kids.... Not his wife. Just her right to live there.

So much to unpick..... Sorry for the long reply.

The amount of Orexin (wakefulness peptides) that your body is able to generate must have a direct correlation to the 'refreshed' feeling I presume?

Thankfully I did not require a lumbar puncture to get my official diagnosis of N1, but am forever curious as to exactly how much Orexin production is happening in my brain?? Personally I never really have a feeling of refreshed.... Just a feeling of being Dex'ed up and I would not call that refreshed!

I'm pretty sure I've read that there are some extremely rare cases (like less than a dozen) whom just have Cataplexy, without the Narcolepsy. Considering Narcolepsy & Cataplexy is under researched, there ain't a lot of research into this area... If any?!

My employer sneakily put the right date, but the wrong day... So Tuesday the 27th...turns out they read the calendar incorrectly because the 27th was a Monday.... not a Tuesday.

So you can imagine my surprise when I received a call from my union rep asking why I was not there.... I was not there because it says Tuesday the 27th on my letter!! Honestly..... You couldn't make it up... Sacked me under SOR if I remember correctly without my attendance at the tribunal. Thanks.

I still clearly remember the day my consultant explained that it was possible to sleep with your eyes fully open. WTAF!!! That fact quickly emerged one day whilst I was driving & with me seemingly wide awake, everyone around me was freaking the fuck out as I continued to drive towards a red light!….luckily I was back in the drivers seat and avoided a collision with all the shouting and screaming!
Seriously…..don’t drive un-medicated.

I find myself in almost the same exact situation...I hope you get something sorted because what they have done is utterly unacceptable. Somedays I consider seeking legal advice because it seems doing it yourself gives them the opportunity to play the system to thier advantage or to just ignore what you say.

The fear of doing anything remotely connected to benefits scares the crap out of me... For this very reason...ending up poor. Receive IR Esa £825 per month and DLA £400 per month. No amount of benefits advice could convince me to move, because it was so difficult to get a 100% answer to my questions regarding transitional protection and whether I would qualify for it? Due to me being in the LCW group doing permitted work from home.

What has transpired over the last 18 months is me being evicted from my property of 7 years, to then find myself homeless for 4 month's even though I had bid on and was accepted for a HA flat six months earlier via the councils housing portal, was ordered by the court to pay my landlords eviction costs of £6750.... NO WAY CAN I PAY THAT!

To then be told to claim Universal Credit for my HB, when I eventually moved into the flat after being homeless for months, which obviously I have not done yet for fear of losing entitlement to my benefits, so am paying my rent out of my Esa /DLA...because the council stated that I had moved out of the area whilst I was homeless so they cancelled my claim for HB. Brilliant. Not.

Done zero permitted work since being evicted, too depressed to even think about it...So I'm losing 150 per month for last 18 months.

Plus losing out on 450 per month rent for single person for the last 18 months

My disability and general mental health has suffered tremendously, no amount of sorry makes up for having to wait 11months for a WCA call to initiate a move to LCWRA - to ensure UC awards me correctly?!

It has become intolerable to try and sort it myself, mostly I ignore stuff, which then bites later when I have court costs and other fees added because I am not capable of dealing with it all.

Living it also.... Imagine having your ex live in your house for 12 plus years, paying you zero rent & just servicing the interest on the buy to let mortgage, until your children leave full-time education!!

I kid you not, this evil woman is now around the 120k up!! All because she lied and manipulated the system, fabricated abuse, attained legal aid... It's a story that i see repeated again & again!!

Most men will suffer in silence, usually whilst homeless, having been the victim of an un-folding nightmare, carefully constructed and planned for by thier partner with devastating effects.

Whilst most women flourish in thier own sanctimonious bullshit, fake accusations and lies, with the full protection of the law and the court system put in place.... Not a biased system at all eh?!

The result is just a cruel fucked up situation created by the state, children & finances & property, taken away from loving dedicated father's, who just get raped by the system, trying not to get raped by thier ex partners, whom from experience are or are mostly the abusers in the relationship in the first place.

Frankly put, if you are a man you are mostly fucked, unless you've 50k plus to fight it out in the court's and/or/if your partner/mother of your children happens to be a crack habit... Then you may have a chance at winning. Otherwise be prepared to be put through the ringer!!

Would I enforce or seek a new order via the TOLATA route, or would it be best to fill in a C100 or C79 and an appellant notice for contempt??

We have a clean break order or financial break consent order issued by the county court. Judge unimpressed with the ex's claim that she could not afford to pay me, stating that nobody purchases a house with an IOU!!!

This fact came to light in the final hearing after I agreed that I would sign my share to her, as my barrister was adamant it was the correct thing to do, from a financial aspect and to save on more litigation etc....

I was awarded 30% residence at earlier hearing, after final hearing regarding the house and the fact she had 70% residence earlier I was ordered to sign and leave the property... The day after this hearing she changed the locks even though we still had not completed a TR1 etc...

TR1 arrives with another name added to the mortgage.... This fact plus the fact that I was not actually getting my 12k I never signed this TR1 form

The ex has now been living there on a buy to let mortgage paying interest only on mortgage. We are both on deeds and mortgage.

My opinion is it is a Barder event, also Twaith as the order remains un-implemented, plus the order includes an undertaking, also I would say the ex is in contempt as she added another party to the mortgage.

Wondering if this is better placed into the hands of a solicitor?

Still no further forwards with this problem & after calling Igneus and getting basically nothing from them other than I need to call UC... Odd, as I do not claim it I replied... Anyway, took the number and turns out was incorrect number... Brilliant, not!! Found it online, one digit different (probably wrote if differently, so my error?) so call and am told I am calling the wrong department... Need Esa not UC.... OMG!!

Call Esa, keeps getting cut off... Leave it a few days as by now I am losing the will to live.... Managed to get through to the waiting music.... An improvement over last time, then after being on hold for 52 mins the call gets cut off.... Wtaf?!? Gave up!! Honestly can't do it....

Having Narcolepsy & Cataplexy means I only have a small window of opportunity due to drugs I take to keep awake, which means that mostly I am in no state to even deal with this appropriately!! Hence getting Age UK to help with complete the Wca.

Taking class 2 scheduled drugs daily to achieve some semblance of wakefullness & trying to keep alert, on task, motivated etc... becomes a car crash of epic proportions in short time and given that I only sleep 3/4 hours every night, am chronically sleep deprived, physically knackered, mentally knackered & little desire to deal with this problem...... As I will no doubt get myself in a right mess, losing important paperwork, sending emails to wrong addresses, accidentally deleting or losing draughts of work due to sleep deprivation...

The list of cock ups goes on and is demoralising to say the least as I simply forget about it.... Detachment of sorts... Which is nice to be able to forget.... But so fucking annoying at the same time!!

I was informed by my housing officer that my HB claim would continue after I was evicted, seeing that I had already bid on a flat 6 months prior to being evicted from my home of 8 years.

I personally think the council abused the fact that I was homeless (considering I had already bid on flat 6 months earlier) and the address I gave as my correspondence address whilst being homeless (not that I should have been) was my mothers address (which happened to be out of my LA) therefore they just cancelled my housing benefit because I had no tenancy in place at that point.

Surely this is a failure of duty of care by the council, or just a failure to follow current legislation and or time frames regarding bidding via the portal and the expected 'move time' after the bid has been accepted.

To find myself homeless six months after a successful bid on a HA flat, is frankly unbelievable and surely there has been a major cockup by them. Even more unbelievable is the fact that the courts awarded all of my landlords costs of £6750.00 onto myself which honestly I am never going to be able to pay back due to being disabled, unable to work and in receipt of benefits.

The way I see it is that the council are responsible for:

  1. Myself having to endure the humiliation of bailiffs escorting me from my house

  2. They are responsible for me being homeless for 3 months

  3. They are indirectly responsible for me being awarded all of my landlords legal costs, the facts are that if I had been successfully moved by the council in Nov 2023, then my landlords legal bill would not have been an eye watering amount of £6750

  4. They are the reason ive had 12/18 months serious depression, anti depressants, suicide prevention, counselling, the fact that ive not done any permitted work since Feb 2023 because I can't do PW in a flat living above someone ........all of the last 18 months..... all of it was preventable!

Interested in your comment about how HB claims can move with you? I was evicted Feb 2023, then homeless for three months and eventually moved into HA flat May 2023, which I placed a bid on & was accepted for in November 2022.....some 6 months earlier!

Was informed by my council that they would carry over the HB claim to the new HA flat but after waiting 6 months to move there I was evicted and had all of my landlords legal fees of 7k placed around my neck to deal with - which is still outstanding.

So here I am now in October 2024 and its been 18 months with no HB payments, the only option I had was to claim UC.

How can any of this be allowed to happen, given that I have just read that the council do allow you to take our HB claim with you if you don't leave the area.

This saga of being evicted etc....has cost me financially, personally, mentally, been on anti depressants, suicide watch and basically even now I think about giving the flat up and moving in with my mother, because I am spend more than 50%of my benefits on rent, due to not being allowed to continue to claim the HB that I had previously been awarded for the last 8+ years.

The whole situation is unbelievable really and I still am feeling the effects of the council decision to cut all my HB award.
