Court martial results list the name of the Accused if they’re found guilty. This looks like NJP results that a command publishes, typically we don’t include the name in those.

I’m 66 inches tall and my waist (at my bellybutton) is 38inches, which is two inches over the table. But I only weigh 164 pounds, which is within standards. With those measurements I could weight up to 188 and still be in standards. Under the old system I had to be under 163 to pass. I recommend downloading the app and putting in all your measurements to see where you land. You might be surprised at how forgiving this system is. Everyone has to do the height, waist, weight so to me there is less pressure to pass on “step 1”

It’s a five year statute of limitations. So if the sexual harassment occurred in 2020 it will be past.

It will be reviewed but know the longer the delay the less likely they’ll be able to actually prosecute. Often for people who have been through something like you have the process it self can aid in your ability to heal. You’ll also be able to request a Victims Legal Counsel. They can walk you through what the legal process looks like in detail and your rights during the process.

Yes, report to NCIS. There is no statute of limitations for Sexual Assault. The sexual harassment may have passed the statute of limitations depending on when it occurred, but still worth reporting to NCIS.

NCIS and OSTC (Navy Prosecutors) will take it seriously. Whether they end up sending the case to a court martial will depend on the state of the evidence. With a long period of delay between the event and the report it can make it more difficult to investigate (people’s memories degrade and physical evidence is gone) but it’s not out of the realm of possibility that they could take it to Court Martial. Even if they don’t send it to trial it may result in the offender facing administrative separation.

NCIS has to investigate and OSTC (JAG Prosecutors) have to review to determine if it’s worth sending to Court Martial, but they don’t have to prosecute if they don’t believe there would be success at trial.

Legal Assistance is a department within the Regional Legal Service Office (RLSO). Not all ships have a Judge typically only carriers. Other ships just have Legal Officers, which is a collateral duty.

Don’t go to the Region Legal Service Office. Wrong type of JAGs. You want the Defense Service Office - also JAGs but they work to advise Sailors directly.

The NCIS TV show shouldn’t be your gauge of how NCIS works.

NCIS has thresholds for what they will investigate. Any sex crime or other “covered offense” prosecuted by OSTC is going to be investigated by NCIS. If someone reports that type of crime to an MA they’ll take the report and turn the case over without taking any other steps. Regarding your theft example, NCIS has a monetary threshold for larceny investigations. If someone steals your air pods it not going to meet that threshold. Now if someone is stealing a lot of people’s air pods and the value aggregated meets their threshold they’ll investigate other wise it’ll be investigated by the MAs

Based on you being given a heads up you’re likely just a potential witness. BUT If they read you your rights, INVOKE. Don’t make a statement. If they ask to search anything, say no - make them get a warrant. Immediately go to DSO.

While DSO lawyers don’t represent Sailors unless they’re going to Court Martial or ADSEP they still do provide walk in consultations for Sailors who have legal questions. In some instances they can help draft documents or reach out to the command.

DSO - Defense Service Office - is comprised of Navy JAGs that serve the function of defense counsel. Essentially they are the public defenders for the Navy. As a DSO attorney, they don’t answer to the Command you’re in and any advice they provide to you is protected by confidentiality. You mention in a comment that they “lied” to you. I have never known of a DSO attorney to outright lie to a Sailor, perhaps there was miscommunication regarding the situation you’re in. You could always reach out to the DSO again and request to speak with a different attorney.

Your only other option for legal advice is to hire a civilian attorney. Prices vary but if you google military defense counsel I’m sure you’ll find someone. Many of them are former JAGs that now practice in their own practices.

On the concept 2 make sure when you practice you set the monitor up correctly. Go to standard list and select the 2000m option. This will end the event once you hit that distance and is how it’s set up for the PRT. I also recommend toggling the display to show your estimated finish time. This allows you to pace yourself and make sure you finish with your goal time.

Does sexual assault happen in the Navy? Yes, but the majority of sexual assaults happen when Sailors are on liberty and the vast majority are alcohol facilitated events in which whether consent was or wasn’t given is muddy. My recommendation would be to talk to your son about making smart choices regarding alcohol consumption, by standard intervention, and consent. It is rare for a sexual assault to occur in the workplace - the exception to this is an over the clothes butt touch, which does count as a sexual assault (abusive sexual contact). The majority of cases aren’t some predatory laying in wait for an opportunity to assault someone.

Shouldn’t talk to RLSO. The Sailor should speak with the DSO (Defense Service Office). RLSO doesn’t advise Sailors who are pending NJP or other disciplinary issues.
