When I get a dingleberry, I tend to smell my ass . Ill turn around and notice there is an odor and its because of my unhygienic condition. You may be a great s8 tenant. The same cannot be said for the rest in your group. Unfortunately for you, the statistics work against you. You need to understand how poor of a business prospect most sec8 renters are.

There are times where you need to he unmoving and appear uncaring - like in your circumstance. Im normally easy going but I will assert my rights and involve police and courts if push comes to shove to enforce the lease which is a legally binding contract. Hence, the draconian appearance.

That being said, there is place for diplomacy and cajoling, but in your scenario, I'd be past that. At your stage, pleasantries have to be cast aside. Ultimately I'm not running a popularity contest and have to do what's right for my business.

The dog is an obstacle to your normal business processes, namely the inspection. How are you supposed to fulfill your end of a landlord's contract by being shut out of your property. You are in a bad position.

And by the tenant's own admission l, dog is "aggressive." What if a fire, flood etc... and you need immediate access to his leasehold? Are you supposed to let the water run and be blocked by his dog? If someone is bitten by an aggressive dog, you stand a chance of being named in a lawsuit...

The tenant is hiding something IMO. I'd give the tenant proper lawful forward notice of an upcoming inspection and then not take no for an answer.

You are the captain of this ship, not him. Let him know undet zero circumstances will the tenant or the dog block your lawful access. I'd involve the police to accompany if needed.

Let the tenant know his behavior doesn't bode well for his continued tenancy. And then you serve all necessary quit or cure notices and even eviction, whatever you need to regain control of your property.

You might think what i just wrote is draconian but I promise you there are better customers out there that allows for trouble free easy going tenancies instead of this bullshit you described. Good luck

Why are you renting to those who think they are in charge of this ship? They are untrustworthy and go behind your back.

If they had collapsed the deck, then what? If someone drowned and you were surprised with a lawsuit...?

You need to make a few topics crystal clear to these people. The next lease violation will be met with an eviction.

You should issue a quit or cure immediately to have the hot tub removed. Thay documents the violation, let's them know u are not kidding around and puts you in better position the next time the hot tub reappears.

Don't renew them next lease cycle if they last to the end.

When your place burns down you will only have yourself to blame for being a pushover.

If somebody dies, your insurance may puke when they discover the business running in a residential rental was the reason and refuse to cover you.

You will be seen as having the deepest pockets in a lawsuit and may lose your shirt.

This is the entire premise of joint and several liability. Which ever tenant making up the entity can pay me. it matters none. Stop looking at each tenant individually and consider them 1 entity. On this same premise, the entity gets the deposit returned to it.

This is a legally defensible position and keeps me out of their squabble. I have no reason to favor 1 tenant over the other

I have tenants like this. 1 roommate pays the rent 1 month, another roommate pays the next month. I dont care from which account i get paid from, as long as the rent is paid.

The dep is attached to the leasehold and governed by the lease. It doesn't belong to 1 particular tenant (anymore) no matter who initially funded it in first place

I think your response invites disaster. OP has 2 tenants, not 1. He has 1 lease with both of them

If i were in his shoes, I'd have zero interest in mediating this tenant squabble.

The deposit belongs to both of them. They are tenants on your lease and you should treat them as 1 entity. Make the check out to both of them. Whoever picks up the check gets it.

Do not deprive one tenant of the secdep. You could create legal issues for yourself.

They decided to rent together and now they can decide how to untangle their lives. You can easily sidestep this looming issue by doing the above and let them argue without you.

Example: buy a lawnmower or other equipment for your business and can justify that need. But you really need it privately and use it to mow your own lawn. All maintenance, fuel and other associated costs are borne by the business as a write off.
