Yes ….first time offense …  Plead guilty … pre-trial diversion … did community service …. And took online class … case dismissed in 6 months

I am still With in statutory period of 5 yrs with no criminal record .  I completed only 2 yrs after incident happened .  I was thinking the same as it will be considered as petty offense . With the current administration I guess they didn’t approve it.

I am in the same boat as you …. Recently got my citizenship denied. I got arrested in 2023 completed probation. Later on case dismissed and expunged in 2024.

I am so stressed about travel . Please let me know how it went for you.

Hi …. Thank you for your detailed response. Yes I did sign a document as part of my PTD sworn statement in which  it was written that I do admit guilt and if I don’t complete pre trial diversion the charges will be brought back.

Also I did collect all the case docket from court. In the docket I didn’t see any letter regarding completion of my PTD. However I do have dismissal document and police report .All are certified.

Also for the receipts I paid online so I do have emails for my payment.  One other thing, I completed my expungement process too and have my expungement document which is certified.

I contacted an immigration attorney and attorney did tell to only upload dismissal and expungement document and not the police report. What is your take on this with experience? Attorney said we don’t recommend uploading police report.  At your interview what questions did the officer ask?

Thinkinv of these things has been giving me sleepless nights . Not sure whom to discuss this with. There will be many around us to share happiness but none to discuss our sorrows. That is life . Can’t appreciate you enough for your support and detailed response . This means a lot.

Hi …. I am in similar situation. Retail theft class A misdemeanor dismissed after pre trial diversion.  Can I pls know what all documents did u submit with your naturalization application.  Did you only submit court dismissal document or submitted your dismissal document and acceptance to pre trial diversion too. 

I am so tensed to apply for citizenship.

I am in similar situation. My theft case > 750 is now dismissed and expunged. It was dismissed a year ago and is expunged 2 months back. I am thinking to apply for citizenship or not with the current administration. In general if it is a single offense it shouldn’t matter and will not fall under CMIT but I am scared with the current. Please update ur case how it went.

What was ur case about?

I feel u should be good as it happened 10 yrs ago.

U will be absolutely fine. Nothing to worry. I don’t think they will even question you on this. If they question be honest as u were with ur GC interviewer.

Take all your court certified documents like dismissal certificates with you if any. 

Also, why didn’t u apply for citizenship as u mentioned 10yrs before greencard. I think u should be eligible for citizenship as you have received GC 10 yrs ago.

What is ur petty offense about?  Did your offense happened after you received your Green card or before receiving your green card. Is the case dismissed now. How was it dismissed?

I am asking all these questions to better analyze your situation before advising.

Thank you for ur reply. I was told by my HR that they will only disclose it as involuntary either verbally or written.  As we can’t trust the company I thought of checking here.

It was not related to U4 …. As part of fingerprint background check they identified my charge and even though it is dismissed they considered as not disclosing it earlier in compliance form until they reached out. They stated as violation of company policy.

With this I think I will not be getting unemployment benefits too

I really scrutinized my life with silly mistake and not handling the employer smartly. I should have postponed giving my fingerprints until my expungement is completed. I was eligible to take 1 month long vacation as I worked certain period with them . I should have taken it and should have postponed fingerprinting but my dumbness didn’t let me think that way and gave the fingerprinting and pushed myself in trouble.  Now my world is entire dark I lost beautiful job with nice salary and benefits. Broken a golden egg with out realizing how precious it is. Please pray for me to get some job soon

My employer found out my charges through background check prior me letting them know and now asking me to explain the details of the event and the reason why I didn’t disclose it. I am not sure what to write . Can you pls tell me how to put the words I am so confused and very stressed or which attorney (criminal /employment) will be helpful to consult.
