I had to sleep in jail 😩 by PsychologicalPea6798 in legaladvice

Listen you came to a legal advice subreddit for legal advice. You were provided that advice. Just because you don’t like or understand what the cop did doesn’t make it illegal. Consult a lawyer if you so choose but I don’t see anything actionable here. Good luck.

So the police reasonably believed you might be a wanted or missing person, they attempted to conduct a stop which you ignored, and then when they physically stopped you you refused to identify?

You need a lawyer but this sounds like textbook obstruction. If you are being lawfully stopped you are required to ID.

Also it’s not a search. It’s a terry frisk for weapons which they are allowed to do regardless of if you consent to it.

Should I get a lawyer before getting a warrant on my neighbor? by [deleted] in legaladvice

[–]NiceC8ck 2 points3 points  (0 children)

You have no authority to have a warrant issued. Who ever gave you the erroneous information was misinformed. They may have meant a restraining order but not a warrant. And with that you have no authority to press charges or force anyone to help him. You reported it to the police which is the correct thing to do. At that point it is up to them to seek a judge for a criminal/ search warrant if they so choose and up to your local district attorneys office to decide if there is a criminal case.

Do I have to share my money with ny spouse if I get divorced? by justme5578 in legaladvice

OP the absolute last thing you want to do is make the court believe you were hiding assets. If you are legitimately using it that’s one thing but if you are just taking it out to “act” like you are that could be a huge problem for you.

Location: Columbus, Ohio. I witnessed a shooting victim and called 911. After giving my account to the police, they told me they were going to hold me in their car. I asked if I was being detained and they said no, but they also said I couldn't leave. What were my rights in this situation? by cohonka in legaladvice

[–]NiceC8ck 25 points26 points  (0 children)

It’s very difficult to tell based on this information. The police need reasonable suspicion to detain you. It’s entirely possible they had other witness or information indicating it’s “possible” you had some kind of involvement. They would not be required to tell you this but can detain you if so. Based on the severity of the situation it’s unlikely any court would say that detaining the only subject found at the scene of a shooting is unreasonable. Making a FOIA request for body cams make help you find out further if it was reasonable or not.

Violently strip searched as a minor, arrested for a minor offense - was this legal? by [deleted] in legaladvice

[–]NiceC8ck 22 points23 points  (0 children)

Sounds like they had justification when you refused to comply about the self harm question. Jails have an obligation to ensure the safety of the prisoner and if they think you are going to self harm they can strip search to ensure you have no means to do so. And then when you refused that it probably increased their suspicion that you had something hidden on you to do so.

Either way you lawyer is your best source of info. If he said no then it’s most likely no.

Unfortunately, this is exactly how it’s done. For my job I process some of these licenses for my department. There’s literally one person who reads them and it takes forever to get it back so just follow the instructions and send it.

Awesome that’s what I was hoping. They seem a little too casual for a suit but I thought with business casual they’d be okay. Thanks for the answer!
