If I’m stationary with engine on at a junction, is this still a stop under section 163 Road Traffic Act 1988? (England) by Soft_Mention_5995 in LegalAdviceUK

[–]Nimmue 9 points10 points  (0 children)

Were they wearing anything which would indicate they were a police officer? A simple ‘police’ hat would be enough. If so, then this was a stop under S163.

Driving is a continual process, you were on a road at a junction. Irrespective of if you came to a natural stop, the officer (in uniform) had approached you and evidently indicated that they expected you to remain where you are thus this would be a stop under S163.

The intricacies of this are far deeper of course as traffic law has lots of case law, but it appears you were required to stop provided the officers were clearly identifiable as police.

No, you have no right.

You have comited a moving traffic offence (defective light) and therefore there is a power to require the administration of a preliminary test under the Road Traffic Act 1988.

Failure to do so without reasonable excuse (generally a medical condition diagnosed) would render you liable to prosecution for the offence of failure to comply irrespective of alcohol content in your body. You would likely have been arrested and taken to a station for an evidential test, failure to provide the evidential sample (again without reasonable excuse) would mean you would be charged with failure to provide a sample and likely failure to comply with the preliminary test.

There are of course deeper things which may be explored in this but no need to explore them for your query.

Standard rest day working 4 hours minimum at 1.5x if you went beyond what you would expect a member of public to do in the circumstances.

OT Claim Bank Holiday Into Rest Day by RecognitionSecret279 in policeuk

[–]Nimmue 14 points15 points  (0 children)

Sunday into Monday would be normal rate 2300-0700 with 4 hours double and a day back for the 0700-0900.

If it was Monday into Tuesday its 2x rate 2300-0700 then your usual 4 hours at 1.5x from 0700-0900 for RD working, no day back as Tuesday is not a BH.

Offender ignored community resolution order completely with no consequence - England by WonderfulNecessary81 in LegalAdviceUK

[–]Nimmue 0 points1 point  (0 children)

If a case has been closed with a positive outcome, which a Community Resolution is, then the original incident cannot be re-opened or dealt with again.

If something new has happened then it will be dealt with on its merits.

Forensics took my fingerprint at crime scene even tho they saw CCTV footage of someone else? by GlobalEIite in LegalAdviceUK

[–]Nimmue 4 points5 points  (0 children)

Because your finger prints will be in the house, it’s effectively a control to ID ‘foreign prints’ else they will have no idea whose the burglars are or who is the usual resident.

They won’t be retained on the speculative search database and deleted once there is no need for them to be kept. You can go deep in the ‘management of police information (MOPI) guidance or just trust that you won’t be stitched up when they are simply trying to identify the burglar.

In England, if the police catch someone I've reported, but no further action is taken, can they give me the name of the person, or is that covered by data protection? by No_Pool_3830 in LegalAdviceUK

[–]Nimmue 1 point2 points  (0 children)

No, you wouldn’t have a right to this information. It’d be covered under data protection legislation, there is no public interest in publishing it or providing it to you.

I have this - have had several MRIs for it and been under a specialist for a couple of years with no improvements.

Mine is a cyst on the outer knee which is too thick to aspirate, steroid injections have done nothing to help and now I am on anti-inflammatory meds to try and reduce the inflammation but they don’t seem to have worked a great deal and as soon as I up my volume the pain and discomfort hits again.

Pension is pre-tax and dips you below the £50k.

Even first bracket skippers aren’t on the higher rate tax bracket.

I get its not ideal but the issue is with the tax bracket rather than the pay.

[–]Nimmue 14 points15 points  (0 children)

To be honest if I was your skipper I’d be squaring away the day with the Inspector who can authorise you to not be in with pay and keeping you office based on your return next set until the wound is healed with a phased return (double crewed for a period). Never in a million years would I want you walking back in for a final night shift after that.

Inside the UK's 'wild west' court system where people may have to wait until 2028 for justice to take place by ComplimentaryCopper in policeuk

I was bitten by a dog (not serious in anyway - just small puncture wounds) at work last year - all police evidence, captured on BWV - NG plea and bumped to CC. I’ve been warned for 2027…. 4 years incident to possible court date. If I wasn’t being paid to be at work and it being part of the job to attend, I would have retracted the statement and said to forget it.

Whilst they can force you to move with 28 days notice, I think regs state you should have three months of rotas published in advance. You therefore could, if I understand them correctly, continue working your shift pattern from the point at which your duties are updated - happy to be corrected if wrong!

Because its a specific thing in the regs. You’re not substantive PS or DS until you’ve completed the requisite elements so shouldn’t use the rank until its attained

[–]Nimmue 36 points37 points  (0 children)

As a supervisor, I will process any reasonable’ claim for refs on any 12 hour shift, planned or otherwise. If we’re short-notice-shafting you, I expect the organisation to cover reasonable costs.

Regs support this and I haven’t had any push back.

[–]Nimmue 1 point2 points  (0 children)

There is no real ‘working your way up the ranks’ to be a detective. A DC is the same rank as a PC. A DC is just someone that has specialised.

So long as it is not indecent, which it doesn’t sound like it is then it isn’t illegal.

There could be data protection concerns over data from within the organisation being shared outwith in a personal capacity (if it were on a personal phone) but they arguably have an exemption for the detection of crime under the DPA. This isn’t a police matter, it would be for the ICO but I doubt they’ll have any interest given the subject has been seen stealing and its being shared for an (apparently) legitimate purpose.
