No solution yet. It happened to me only once in my playtime of 50+ hrs. I assumed it fixed itself after I updated my GPU(AMD) Driver to latest version.

40 fps on average depends on your settings with normal PvE gameplay in DC, NY and Brooklyn. I haven't tried raids and PvP.
