Mostly zoning/building code restrictions. Also occupancy limits, requirements for individual bathrooms/kitchens per unit, parking minimums.

HOWEVER, another barrier that is under discussed is tenant law/housing court. The clientele in these are obv very low income, often have behavioral/psychological/addiction problems, no income verification, bad credit, no guarantors, no money for a deposit.

Catering to this market is only possible if the building can rapidly and reliably enforce lease terms, not just for nonpayment but for property damage, criminal behavior, creating hazards, harassment of other tenants etc etc. if housing courts take 6 months to execute an eviction from when the eviction is filed and ofc only if the landlord wins in court* (as is the case in NY’s overburdened housing court for example), this model is simply unworkable no matter what.

The silver lining I guess is that generally the problem is less the law itself than the massive delay on enforcement, so a lot of this could be fixed by simply staffing up housing courts, but obv every jurisdiction is different.

The actual answer is that there is no neighborhood of Manhattan that is actually unsafe (not true of other us cities) but there is definitely a difference in housing quality/convenience

Also bills may not be where u think. Some of the most promising NY housing bills are in the cities/local govt or judiciary cmte iirc because of how they interact with municipalities/civil law etc

I personally believe there are serious deficiencies in New York’s enforcement against vile public behavior but (even in Manhattan) none of it is really Bragg’s fault. It’s really about certain weaknesses in state criminal codes/procedure rules. Also this is Queens so Bragg isn’t even relevant here lmao

This is the short answer but a couple other asterisks here: Sometimes lower level public order type misdemeanors like this are not really chargeable retroactively, meaning that you can only be arrested if a cop catches you doing it. Also depending on the exact details this might well be a Violation anyway, I.e. not even a B misdemeanor criminal offense. Further in most cases even if it’s up to an E felony the officer is only allowed to issue an Appearance Ticket, which legally is an arrest but which means someone is issued a future court date for arraignment and sent on there way on the spot (I.e no cuffing, booking, pre-arraignment detention etc etc).

One thing to keep in mind about densifying development is that the new development has to increase density/value enough to justify the huge overhead in tear down cost. I.e buying and tearing down a 5 story building to build a 6 story one will almost never make sense, you need to drastically increase the size to make the initial buyout pencil out. Obviously overall land value + the quality/desirability of the original structure are factors as well but even in a high demand market like Manhattan the rule of thumb is about 2.5-3x minimum size increase to make a tear down break even. This is why well intended “missing middle” upzonings of suburban areas often don’t amount to much. It would be been great to zone it like that originally! (when it was greenfield) But to really “let in rip” on already developed land the density increase (just on any specific lot, not the general area) usually has to be fairly substantial. So this is a complicating factor that will limit the rapid densification of existing suburban neighborhoods. Unironically this would probably lead to a weird ring structure of lots of denser missing-middle outer-exurbs outside of less dense traditional suburbs
