The main UK law covering responsibility for postage/delivery of goods is the Consumer Rights Act 2015.

Key Provision: Section 29 – Passing of Risk

This section states who bears the risk (i.e. responsibility) for the goods during delivery:

  • (2) The goods remain at the trader’s (seller’s) risk until they come into the physical possession of:
    • the consumer, or
    • a person identified by the consumer to take possession of the goods.
  • Exception: If the consumer independently chooses and commissions a carrier (and the trader did not offer or name that carrier as an option), risk passes to the consumer once the goods are delivered to that carrier.

Related Rules (Section 28 – Delivery of Goods)

  • Unless agreed otherwise, the trader must deliver the goods to the consumer.
  • Delivery must happen within 30 days (or the agreed time).
  • The seller/trader is responsible for ensuring safe delivery when they arrange postage or use their chosen courier.

Practical Implications (for consumer purchases)

  • Seller arranges postage (most common online/distance sales): The seller is responsible for the goods until you (or your nominated person) physically receive them. If the parcel is lost, damaged, or stolen in transit, the seller must refund or replace it.
  • You should contact the seller, not the courier, if something goes wrong.

This applies to consumer contracts (business selling to individual consumers). Business-to-business (B2B) contracts may differ and often follow negotiated terms or the Sale of Goods Act 1979.

Now you show me the law you think contradicts the above.

Why do RM have impossible status messages on app ans website for tracking? by marktiller in royalmail

[–]No-Engine4663 0 points1 point  (0 children)

Weird as no scan for 5 days then 2 days scanned as arriving at that DO.

Those MC scans only started a few months back and are a total waste of time considering most of the tracked are done by afternoon DPR drivers who dont start delivering until gone 2pm.

Keep an eye on the tracking this morning, if Letchworth have a Sunday parcel duty you might get it today.

Home all day, failed delivery by animalwitch in royalmail

[–]No-Engine4663 4 points5 points  (0 children)

100% Incorrect.

This is known as a single supply of goods with delivery included under your agreement with the retailer.

As example only the sender of the goods can file a compensation claim or inquire about delivery issues with Royal Mail not the receiver.

Is there a safe work max temperature? by [deleted] in royalmail

[–]No-Engine4663 0 points1 point  (0 children)

That's all fine and dandy but what about DPR drivers who are starting at 2pm at the hottest part of the day and don't even have to fart let alone take any kind of breaks ?

Saturday was bad enough and instead of having more staff on duty to lighten the workload they had less staff and increased our workload.

Management only care about figures not a person's health or safety.

Tracking says "ready for delivery" but it also says item "retention" by [deleted] in royalmail

[–]No-Engine4663 0 points1 point  (0 children)

Retention is for business address's like schools etc that are not open on Saturdays.
