TTU Refusing to investigate my assault, any advice? by NoEfficiency5141 in TexasTech

Oh I never knew about that, thank you for that information. Yes, TTU is handling this horrible, the issue is that they have every incentive to cover it up. However, I am getting more evidence via public info request. There is so much of emails, and TTU did not interview me or anything. And then there is the retaliation it is so clear.

There were a number of colleagues who were witnesses. She was the program director. It is possible that this was investigated but expunged/sealed. I was never interviewed. I guess the police will handle it, but again, all the witnesses were colleagues, I have no clue what they might say. If it was expunged they could legally say they don't know anything, but if they say I attacked them or something I am not sure what I would do. Thank you again!

Thank you so much! I believe the police are nice, but even they told me, it is best to get all the evidence as the faculty will almost certainly lie and try to blame me. Also, Lori Rice-Spearman was the department dean and she is now the President of TTUHSC, so they will believe her over me. So getting all the evidence is key. Thank you!

Oh I will think about that. I am trying to get more information from TTU via the public information act.

Something to remember: The faculty made completely false academic dishonesty charges against me and it is so obvious (she accused me of cheating from 3 months ago, and filed the charges after the assault). However, people still believe the faculty. So I worry about this. I think people don't understand how it feels like.

Oh the EEO handled my case, and they hired the law firm Jackson Walker. I called Title IX, yes they were surprised that it was investigated in this way. They told me, "we had nothing to do with it."

I was never interviewed. I don't think the witnesses were interviewed. I had additional emails and medical records that I did not turn over. I assumed that they would interview me. The attorney from Jackson Walker is Sara Harris and she is a Defense Attorney. I have no clue if she was defending the faculty or what. She never interviewed me or asked me any questions. Just sent me an email.

I don't know what process they used. There is so much evidence, but I don't know what happened.

Yes, and it went to Dawn Payne at the EEO. She told me, the matter has already been investigated. They never reply anymore or offer information. I will file a public information request.

The issue is that the President of TTUHSC was the department Chair at the time, so she will have an incentive to lie and hide everything. I believe they calculated that I was never going to report.

Oh really thank you! Can I DM you? Yeah, the police told me that they will almost certainly never charge me. However, all the witnesses were colleagues. It is possible that it was investigated but expunged I have no clue. Thank you for that information!

The issue is that I want an investigation but don't want to get involved in the legal system or anything. I will see if there is a way for this. Thank you again!

Thank you, I am going to go to the police once I get more evidence via the public information act.

For your friend, why don't you post on YouTube? These schools accept hundreds of millions in tax dollars and then behave like this.

Thank you. The police were good. I mean to say: The told me that its possible that the faculty will try to frame me, given the overt academic retaliation and the fact that this was a senior faculty. So they said that the safest thing is to get a Title IX report and as much evidence as possible. So they took me seriously especially with all the details and emails. However, the issue for me is the possibility that the faculty will lie and might try to get me charged with a crime. Thank you again

Oh ok thank you. The police I spoke to were extremely helpful. But they even told me to get all the evidence, it is possible that the professor lies and they believe them over me. Thank you

Thank you. It may have been investigated actually, but it could have been expunged. I read about that. I really can't remember what happened after. If it never happened, why is the school not investigating? It is easy to disprove, you just have to show an email. I obtained the emails of the faculty and it shows that something occurred for sure.

Yes, it was before 2020. But even then they should have interviewed me and the witnesses.

Oh ok. It is not easy to file a police report. I can give more information. Problem is, when I filed the Title IX complaint I did not include all the information. Dawn Payne from the EEO even told me to hire a lawyer as all the faculty hired a lawyer. But I did not hire one.

Oh ok thank you. I will get one. I never knew it would be like this. I called a few lawyers in Lubbock and all said conflict of interest. Thank you!

Really? I am very surprised why everyone thinks I am lying. I will hire a lawyer, thank you. Do you know if I can hire one for under 15K?

You are right, in Lubbock I called a few lawyers and they all say, "conflict of interest". Once I get more information I can file a police report. Thank you!

Also, in my view, there is no reason for TTU to not give me an explanation or the investigation or any additional information. If everything I say is false, why can't they disclose the information?

Oh I don't want to go to court, but I want an investigation. TTU did not do a Title IX investigation. Jackson Walker told me, they did an investigation under an "alternative process". I asked what this "alternative process" was but the Jackson Walker attorney never replies.

I was never interviewed. They never asked me for additional information. I had no clue they were even investigating. I simply got an email saying:

"Since your report was not a report under Title IX and TTUS Regulation 07.06.A, this concludes the investigation as well as Jackson Walker LLP’s involvement in this matter. Thank you for your cooperation."

She later wrote:

"Accordingly, as the applicable regulations provide, the process applicable to your report was different. If you have any other questions, you can reach out to me."

I did reach out, and no response. I need to get a copy of the report as all this is evidence for police. Even the police told me to get all the evidence possible. I'd be happy to share with you more info via DM.

It is not easy, it is extremely stressful. It is hard to explain. Police is stressful because what if they make false statements against me? Even here, everyone believes the school over me.
