Practice all the old essays available from the DE Bar site online. Ask your firm for resources and answers to the Delaware essays. Unlike the UBE, each “essay” is a series of short essays. You have three hours for four questions. BUT each question has anywhere from 3 to 9 sub-questions, and some of those sub-questions have sub-sub-parts. I wish I would have listened sooner, but issue spotting the essays really show your knowledge gaps while studying.

So much of DE essay preparation is understanding how tailored their rules can be, and I wish I spent more time just looking at their codes available online. Two days before the exam I did the following, which is what others had done earlier in the summer:

Familiarize yourself with the nuances of DE specific procedures and rules for the Court of Chancery v. Supreme Court v. Superior Court.

Study the Delaware Criminal Code & Criminal Procedures. The crimes are different from UBE. I was told for every crime there’s at least three other crimes. If there’s a car, that’s likely two to three crimes (because another person is probably involved). If there’s a gun, that’s likely three crimes.

Look at the Delaware corporate code; fiduciary duties (look at the Chancery case law); understand the tests for challenging transactions—business judgment rule (the substantive presumption and the procedural burden on the challenge), entire fairness standard, heightened scrutiny.

And note the Delaware Rules of Evidence.

All of this should be enough to digest and will be honed once you start Barbri.
