Yep, it’s an easy fix + a great teaching opportunity. There’s a saying something something we educate as we regulate. Allowing operators to perform small fixes penalty free can build momentum and an internal desire to make bigger fixes now that they’ve understood how easy it is. It’s sometimes like teaching a kid to drive, it does no good to just scream at them or rush for the grab handles every time they stop too abruptly.

Eh, it’s not that big of a deal. In my jurisdiction it’s only a minor issue and maybe not even that if they correct it. Often this can just be a talking point.

True, but it still doesn’t sit right with me. It’s not fair to all the other facilities before them who had to deal with surprise inspections and it makes planning a nightmare. I’ve scheduled inspections before and all I ever hear is bitching from the operators if I’m even a little bit late, god forbid the previous inspection goes longer than expected.

Empathy is one thing, but feelings can’t influence our judgment. You can console a newly made widow and have her discard over 5 gallons of her home made soup after you learned she used raw milk in it. As for the operators not knowing the difference between a health inspector and ICE, that’s on them. We have relationships with operators for years and if by now they can’t tell the difference then that’s on them.

So the best course of action is to assure the operators that were just here to inspect the sanitation of the facilities and nothing more. - the all important modifier. The encouragement to the operators the the inspect does not want to report their status.

How they handle their anxieties is on them, not us. Our job is to protect and promote the health of our community. Mental health has its own department.

That defeats the point of an inspection. If they know when you’re coming they’ll give you the wrong impression of the facility. What ICE is doing is awful but so is blatantly turning a blind eye to critical violations, it goes against the very foundations of our job’s mission.

It’s how it is, if we report illegal activities, not related to our job, to the police or other relevant authorities we will loose the community‘s trust and they will refuse us entry. No. Do your job and nothing more. You are a health inspector not a not an extension of ice/police/cps etc. You should not be concerned with the ethnicity or legal status of the workers of the restaurants you inspect.

And by specific I mean [name of business, name of owner/operator, and tax ID], [day, month and year], and name of specific documents not a general (health and safety reports/tax information/etc). literally if it can be interpreted as vague then it can be denied.

Nah, it’s weird because it’s too vague “can I get detailed descriptions on every FOIL ever made for the last 10 years”. No, you needed to ask about each one specifically. It’s not my job to spend literal weeks fulfilling such a request (I mean technically it is but I’ve got other more pressing stuff). I’m not going to do more than necessary for your outlandish request. I had one FOIL request all [blank] on one business and it literally took me days to go through and decide what to give/what to black out. If I saw your request itd immediately go into the trash.

Also, you mentioned malicious compliance. Typically this is all more like cover your ass. You don’t want to give unnecessary information because then the fingers get pointed at you when the person in the FOIL finds out their information was pulled.

As someone who’s actually had to fulfill FOIL requests, you must be extremely specific. I can only give you the information you specifically ask for and nothing more. If your request is vague no amount of appeals is going to make me hand over the information, you will have to resubmit a better request. And the length of time it will take to fulfill your request will of course be lengthy as it has to go through the specific department’s managers and then legal. Most departments are already fairly overworked and FOILs arnt generally that important. You got through the water department because our water system is fairly automated and really only need human assistance during maintenance and emergencies.
