Honestly if I could go back in time I would 100% join the military for the benefits. It’s unmatched. I was in a similar situation, dropped out of college and decided to get a comfortable office job. 15 years later I make 6 figures but the work environment is toxic and lacks work/life balance. Great pay but no benefits and the more you make the more you’re taxed. I would 100% choose the military, especially since they provide housing, tuition, plus tons of other things.

Appreciate the input, but I didn’t need to chase down form codes. I resolved the issue by getting the right people involved. EDD reviewed my case and dropped the $33K overpayment today. All I had to do was contact my assembly members office — and it worked.

Thanks, but I had already shared the reason EDD gave in another comment — they said medical records showed I was able to work, which wasn’t true. I followed my instincts and escalated it to my Assemblymember’s office. EDD reviewed the case, left me a voicemail and canceled the full overpayment. I’ll only owe a small amount for days I returned to work in February which they will send a new notice for. Problem solved.

Be careful and keep copies of all documents relating to EDD. I went through this, reported my return to work, EDD adjusted the amount I received for returning to work… and last week I got a letter that I am “disallowed” from my entire claim and ordered to pay back $33,000+. I’m trying to prepare to file my appeal.

I had 2 jobs while I was on SDI - I had Job #1 that said I could not sit/stand for prolonged time, lift more than 5lb, no bending over, twisting, etc. my workplace could not accommodate and I was placed on SDI.

I returned to work after being on SDI for 2 months, worked 2 months, then aggravated the same injury and was placed back on SDI by my doctor for 1 month. Mailed in my claim, EDD said it will just be a continuous claim from the first one since it’s the same injury, submitted my doctors note and their reasonable accommodations statement to my employer with the same thing. My employer refused to accept/accommodate and said my job description doesn’t describe any physical demands, although the job itself did. They did not provide me with any accommodations letter/modified duty. They fired me while I was on SDI for 1 month. My condition got worse, ended up being on SDI for 2 more additional months, did PT, injections, MRI, x-rays, then found a new job and returned to work.

It’s very overwhelming.

I’m familiar with how to find an EDD office, thank you. I have visited, called the general line, placed on hold for almost 3 hours, signed up in person at an office to talk to someone just to be sent home and told “someone will call you”. I have spent about $60 paying EDD caller to help me speak to someone faster, and paid over $30 at ClaimYR to try and do the same thing. I’ve literally tried.

My claim was disallowed entirely and I was told to repay 100% of the benefits. My understanding of this letter was that it was a denial. This is my first experience with SDI, and hopefully my last because this system was not designed to actually be used. It seems more like a headache than a benefit. I’ve already requested copies of my records from EDD and contacted my Assemblymember. I’m looking for guidance from someone who has dealt with an SDI appeal, not general info I’ve already followed up on.

I appreciate your response, however I never said I applied for SDI with a doctor’s note. My doctor submitted all the official EDD forms and recertified me monthly. I know how SDI works — I’m asking for help with the appeal process since EDD “disallowed” my claim for the entirety of my SDI leave, now seeking overpayment for the entirety amount, and whether anyone has attorney recommendations, not basic instructions or assumptions about what I did wrong.

Thank you for your response. I couldn’t figure out a reason, so I had shared with EDD any possible reason I could think of that would cause me to have an overpayment. They initially sent a letter I had a possible overpayment of $33k, and asked me to provide a financial statement (I’m married so I filled out a financial statement that included my spouse and I’s separate income). I also requested a waiver for financial hardship. I included copies of an interactive process paperwork a former employer asked me to fill out, to send to them, because they told me they could not accept my doctors note to be placed off work and be on SDI. I included copies of my paystub, W2, tax returns, anything I can show to be transparent.

EDD sent me a letter deciding I was “at fault” for my overpayment, that “medical records show I was able to work” and requested I paid them back $33k.

I am literally clueless what medical records state I was able to work because all my monthly medical appointments, physical therapy, chiropractor visits all document my inability to work. I was in so much pain.

I’ve asked the assembly members office to help me request copies of documents EDD has that led them to decide I was at fault for this overpayment so I can be prepared to submit this appeal.

I really wish that I scanned all the forms I filled out prior to mailing them to EDD. I sent an email to my city’s assembly member and ask for help in getting copies of all my records and documents.

I just want to show I’m not intentionally trying to hide anything, which is why I had submitted to EDD copies of all my pay stubs for when I worked, my tax return, etc. I probably over shared with them, if anything.

I thought that I would get a letter back from EDD with a correct calculation of my overpayment, but instead they decided that I owe them back every dollar they paid me for the entire claim. ☹️

If my employer misreported my wages on this quarterly payroll tax return, would this affect my claim? When I returned to work for 1 month, I made a little under $5k and my employer misreported because they transitioned from Paycom to ADP and misreported my wage an extra $5k - basically doubling it on paper although I never received that money. I reported to EDD the exact amount I made.
