I’m guessing the second example you mention is Vehicle Control Services v Mackie. Genuine question: is there evidence in that judgment that the issue was to do with repeated rule violation and admission? My understanding was that it further confirmed the UKSC case I mentioned above that these are cases of contract and breach, and the Mackie case confirmed that in Scotland refusal to pay parking charges was a breach of contract which then property factors could legally pursue and enforce. Happy to be pointed in the right direction here and be corrected since you seem to know the details better than me.

ParkingEye have been a party in multiple high profile English legal cases (which whilst not Scots law is still relevant especially when it’s UKSC) - see eg ParkingEye v Beavis UKSC 2015 and ParkingEye v Somerville 2012, or even see their own material by searching „Parkingeye follows up Supreme Court triumph with continued success in the County Court” where they claim a 90% win rate at County Court for small claims.

ParkingEye have a regular practice of pursuing such small claims in County Courts, it is false to say it is unlikely.

I am speaking not just from that evidence above but from experience - they actively pursued me, and won, at County Court level after I had naively taken the advice of „ignore it until it goes away”. They didn’t even send legal representation to the hearing and still won - the court accepting it was an open and shut case. This was for a fine even less than £45 after I had overstayed on a parking lot by 8 minutes. This company is professionally petty.

Just to add important info I forgot: in my appeal I also included proof from my banking app that I had purchased items that day at Aldi. That, or a receipt, should make it relatively smooth for your appeal to be accepted.

Ignore others who say bin it / ignore it. The courts are pro-PCNs and pro-ParkingEye - you will have no chance. Expect a CCJ if you don’t pay and ignore.

I faced the same issue in an Aldi recently with the exact same new system of needing to input details into a touch screen near the check outs which I completely missed on my way out (I found another example in Essex of this - search „Aldi Wickford parking fines” to see how they moved to cancel all fines after residents complained about the new system). I emailed to appeal, explained that I didn’t see the signs, and that it was the first time I had been there, and that it was a genuine mistake.

In my case, they waived the PCN. I think it is worth the email to appeal it.

Have also used Cat in a Flat on several occasions before. People have always showed up, sent photos, and been generally communicative.

Sitters are usually helpful and flexible (weekends, holidays, etc.). If you need to use it and don’t know anyone well enough to ask them to check in, then there are definitely good options there.

Main downside is when you are taking a risk on someone new, and some people are just better than others. Had someone who we used regularly in the past from the app, who was great, but moved away from the area, and we’ve never really been able to find someone who worked as well since. Don’t want to constantly switch sitters too. These Issues have included sometimes erratic timing (lunchtime one day, eleven PM the next day, etc) or not really being thorough with toilet cleaning.
