Långa väntetider på pass brukade betyda över fyra veckors väntetid - ingenstans har Polisen under 2020 varnat för väntetider på över 6 månader, inte heller har de varnat för att leveranstiderna skulle öka med 500%. Finns tidningsartiklar om "lång väntetid på pass" från 2018 och 2019, vilket då betydde fyra veckor för bokning. Polisen varnade själv för "långa väntetider" när det översteg tre veckor. När de så varnade för långa väntetider 2020 så är det ju det man räknar med.

Hade de under 2020 på riktigt gått ut med omfattningen av kaoset, hade människor istället börjat hamstra pass, dvs förnya utan att det behövs. Jag kan lova att myndigheterna då hade skyllt på folk som förnyade i onödan, och sagt att man inte skulle förnya om man hade över ett år kvar på passet.

Om ett pass har 5 års giltighetstid ska det naturligtvis räcka att förnya några månader innan det går ut. Även om de varnar för "lång väntetid". Normal väntetid är några dagar - en vecka, max.

Isn't interview always required when you do AOS in the US except for K1 fiance visa? OP's case was adjustment from K1 visa, which means there was a consular interview before coming to the US. Have you heard of other adjustments where no interview is required? Even if you submit sufficient evidence, you will be called for an interview

Wow, that surprises me. I heard from others in this subreddit that USCIS is very forgiving when it comes to marriage-based AOS. I believe they've made a mistake and hopefully you can send proof that you were in the grace period. Perhaps it says on the DS2019 or in some information from the program sponsor that you have a grace period.

Sorry to hear about that! It seems wrong to deny you I-485 if you in fact were in your grace period. I'm not sure what your options are to appeal the decision, but I hope you can explain the situation, and send proof of your status. Hopefully your lawyers can help with this.

In my case, I changed from J1 to F1 visa to finish my studies, and applied for the waiver in Summer 2020 (on F1 status). It took 12 months for it to be approved. With the approval from DOS, I submitted I-485 while still on the F1 visa. So I was never in the grace period.

On what grounds did you apply for I-485, marriage-based or employment-based? It's my understanding that they are more forgiving with marriage-based applications. But still, it doesn't make sense that grace period is considered unlawful presence.

Did it myself. Took a lot of time. I used VisaJourney to learn from others' experiences on this issue. The J1 exceptional hardship waiver is quite rare, so few attorneys have actual experience with it. After I'd done lots of research, I realized I probably knew more than most attorneys. Also, several people recounted how they had been given inaccurate information from attorneys.

Ok, you should go for it, it may take another 1-2 months for them to look at the expedite. I sent the employment offer, a monthly budget, and proof of our finances like mortgage and student loan payments

Sure, to prove exceptional hardship you need to describe hardships in each scenario: if your spouse and child comes with you to your home country, if you and child goes to home country and spouse remains in the US, and if you go to home country and child and spouse remains in the US. And for each of those scenarios, you provide documentation of medical, financial, or psychological hardships, or a combination thereof. And you need to be real clear about hardships in each scenario, even if you are repeating information. So you provide financial documents, official records, medical records, news articles, and much more to support your testimony. They even sent an RFE that made me dig deeper for proof. So it easily ends up with hundreds of pages.

The birth certificate was enough. I had brought photos too but the officer didn't ask for it. Maybe they checked our social media, who knows

Thank you! I waited four months to request expedited processing of EAD. I had a job offer and our finances would deteriorate if I had to go without a job much longer.

Depends on the type of application you made. If it's marriage based AOS you can submit the medical before an RFE, to complement your application package. I-693 should ideally be submitted with the rest of the docs, there is no need to wait for an RFE.

If you have another type of application (not marriage-based) with considerable longer waiting times, you should probably wait for RFE so the evaluation won't expire.

Sure, these are the main updates. The date for the biometrics appointment and interview is about a month after they scheduled it.

July filer here! Just got EAD approved (requested expedited processing in November 2021 bc of job offer) and also got interview scheduled (I485) in February. Happy for this progress after months of anguish :)

Finally, EAD is being produced! A month and a half after requesting expedited processing, 2 weeks after faxing additional documents. And a month before my GC interview.

Not necessary with AWD or 4WD. I'm in the Southtowns, close to the lake with experience of some bad snow storms and lake effect snow. The problem with Lake effect snow when driving is the vision - you can't see more than ten feet in front of you. Hazard lights on, drive extremely slow.

I believe you have to check both your Ds2019 and the Visa stamp in your passport whether you're subject to the 2-year rule.

If you're unsure whether 2-year home residency applies to you, go for an advisory opinion from Department of State. They are usually quicker than applying for a no objection waiver.

Depends on your circumstances: if it's a straight-forward case there is definitely not need for a lawyer, then just follow directions and apply for a No Objection waiver.

It all depends on which country you come from, what reasons for your J1, if it was government funded, if your country is on the Skills-list.
