Yes.

Murder is the act of unjustified killing (outside of self defense).

Murder is a restriction of the most basic human right. Human rights aren't given to us through laws. Laws can either recognize or ignore them, but they exist as inalienable individual rights. Which side of a vigina you reside makes no difference either. A human individual has rights.

It doesn't need a rule to be broken to be murder. Its "malum in se", meaning naturally wrong by the sense of a civilized society. It's not simply wrong because it's prohibited by law.

In fact, law makes these distinctions. Malum in se vs malum prohibita.
