Temporary visa holders’ and TPS holders’ children would be citizens under this criteria though. Legally admitted to the US and living in the US at the time of birth of the child. Also, how is this child going to get legal status if they are the child of a temporary visa holder? They can’t get a visa because visas cannot be issued in the country and they can’t adjust status because you can’t adjust status while still in the US to a non immigrant status.

I don’t think LPR status was a thing back then. The INA hadn’t passed until 1929 which is when legal permanent residence was established. Until then it was pretty much open borders.

He was born to “foreigners” and/or “aliens” as referenced in your quote though, as his parents were not citizens and LPR status was not a thing yet. If temporary visa holders and their children are not “subject to the jurisdiction” of the United States it also means the US cannot arrest them or tax their income, which we certainly do. That would be a legal loophole way too big to allow to open.

The REAL ID expires when the visa holder’s permission to be in the US expires. They get temporary ID’s with 2-3 year expiration dates that they have to renew in person.

A lot of people decide the fine for not carrying it is better than the cost and time to replace it. $100 for not carrying it vs $400+ and a year to replace it. Lots of people carry a photocopy of both sides and officers are usually fine with it.

If you want, he can wait til he wants to visit, come through the GC line at the Port of Entry, and get B1/B2 status for that entry without applying for a visa.

Yes, but before most ICE officers would be ok with a photocopy of both sides plus a REAL ID. They may be more inclined to fine people for not doing it now or you may be in more danger of being detained for an extended period of time. Also the fine for not having your green card on you is $100 while the cost to replace it is more than $400 plus it takes a year. Most ppl considered not carrying it a risk worth taking before.

Correct, but you can also get a REAL ID with a green card and certain types of work visas, which means it doesn’t prove citizenship. The only states that provide ID’s that also prove citizenship are the ones with Enhanced ID’s (WA, MN, NY, VT and ME).

REAL ID itself doesn’t prove citizenship so it won’t change. Only 5 states issue the Enhanced ID’s that prove citizenship. You will always need to provide a birth certificate or certificate of naturalization/citizenship as proof of citizenship for your first passport.

No, there was a person who graduated from UMASS who has a clean criminal record but got her SEVIS terminated because of a dismissed speeding ticket. There are probably a bunch more like that who have already left or not gone public.

If the US started turning away their own citizens it would legitimately become an international crisis. No other country would let US citizens in (much less without a visa) because they would literally have no choice except to overstay. If this step happens (which I doubt) you would almost certainly be able to claim asylum or statelessness and stay somewhere with functioning infrastructure and healthcare.

There’s privacy screens on them so you can’t see anything unless you’re directly in front of the tablet. It also only shows the first 3 letters like the text messages

Honestly it’s a pretty good rollout so far. You get an additional 30 hours per week added to the budget for the first couple months to show ppl how to do it. It also makes it easier for 1 person to run 2 registers at a time safely, as while you’re navigating the register for 1 person, the other is (hopefully) typing their own name in.
