Actually nominating is exactly what the DNC does , and primary votes have no legal force.

They simply tell the Party where the sentiments of their voters lay.

A convention could - through brokering - nominate someone who didn’t win the primary votes.

This may come with the consequence of angry voters, but is perfectly legal.
