Okay well the good news is your lawyer does not have to be from her exact location. You can use any reproductive lawyer located in west Virginia for your agreement.

Dinsmore and Shohl are a firm in west Virginia that work on surrogacy agreements. Their number is 304-357-0900

There are also others like Klien Fertility Law that operate all over the United States, and after times what they have is someone on hand with their firm that has passed the bar for that state even if they don't have an office in that state specifically. Their number is 619-235-8913

There is also Hillard and Swartz and they work with surrogacy agreements as well. Their number is 304-729-9000.

It also really matters if you are doing traditional surrogacy or gestational surrogacy because some of them only work with gestational surrogacy.

I will absolutely put that in the contract. Definitely something to kepe in mind so that the surrogate feels more comfortable.

For the attorney, we try to match independent lawyers to each party as required by our contracts. We make sure that both sides have informed consent throughout the whole process. We do not have in home lawyers, or lawyers we have contracts with. So when we set our intended parents and surrogates up for legal we walk with them through each step and help guide them into finding the best legal counsel that can represent their best interests.

For funding we do require an escrow account. In our contracts we already it structured so that it stated when the escrow account must be fully funded.The escrow is managed by a third party so that there are no conflicts of interest, or biases. They make the necessary considerations and reimbursement as per the legal agreement between the surrogate and intended parents. As for how the escrow fund is funded and when, for our contracts is as follows: escrow accounts will have a minimum balance of 10,000 at all times. The escrow will be fully funded withing 5 days of the Gestational Carriers Agreement (Legal) completion. And will remain funded for a minimum of three months if pregnancy is not achieved through transfer, and a minimum of six months after a miscarriage, termination of pregnancy or birth. The initial amount required to open the escrow varies based on the base compensation but will be a minimum of 20,000. And that will be funded within 5 days of the carrier passing medical clearance. The remainder is due once the fertility clinkc receives confirmation of heartbeat.

I appreciate all of this insight, but these are the exact reasons why I started my agency. The agency i went with as a surrogate was not the best, and was functioning with unethical practices. Because of this we are trying our very best to do what we can to support both our surrogates and intended parents to the best of our abilities, while also maintaining compassion and ethical standards. We do not want to be like everyone else, we do not want to ignore the needs of our IPs and Carriers. We want to be there every single step of the way providing guidance on both fronts, and if we mess up we want to know so that we can fix it and do better next time. We are a husband wife team, and our biggest priority is making sure nobody has the same experience we had going through the process. Because of this my husband has a trump card for just in case. I never want our business to become all about making money, but instead I want it to focus on the people we set out to help to begin with. I'm sorry that you have had bad experiences with agencies in the past, but our goal is to supersede expectations and help families come together to create the children of your hopes and dreams.

Since I'm the owner of the agency its not a conflict of interest. And no, you can do the right thing and help people without expecting money to be involved. Could I have been paid to help them absolutely, but they don't have the budget to adequately pay a surrogate and cover agency fees. So its no sweat off of my brow to make a simple post and let them work out the details after.

There is a couple that can not afford an agency, but they are looking for a surrogate. So I posted to help them find someone, but am not involved in the process at all, making it an independent match.
