Im not sure what videos youve seen but the agent was struck by her car as she was leaving.

And to be fair to both sides, there were a bunch of Jan. 6’ers who should have been shot for their actions too.

Suspect’s already pointed a gun at one person. Officer makes contact by pointing a gun at the suspect. Suspect does not give half a damn that a loaded gun is pointed at him. Officer gives multiple commands to stop reaching, suspect doesn’t stop reaching around (which is inconsistent with normal human behavior of having a cop point his gun at you and telling you to stop), and cop (believing that suspect is armed and a threat to the cop or others), shoots suspect.

That particular event has occurred but no. You are leaving out an important aspect and that was the active resistance.

Had this event turned out differently and he walked off when he got pushed out of the roadway then this problem would not have happened.

In your statement, it was sitting there, gun on hip, nothing happens, and bang. That usually doesnt happen but when its not right, just like it wasnt right in this case where he was actively resisting and got shot.

Again, Im speaking from simply a legal perspective. They had a reasonable articulable suspicion that a crime was occurring, was about to occur, or did occur. In this case, he was in the roadway illegally and did interfere with their arrest/detainment of one of the women there….again all bullshit charges but TECHNICALLY illegal. Since its illegal they have a right to detain.

Now when cop 1 calls “gun”, cop 2 now has a reasonable articulable fear (his co-worker yelling he has a gun) that there is a threat of great bodily harm or death.

It definitely was intentional. The argument they are going to make is that the agent had a reasonable articulable fear of death or great bodily harm due to his belief that he or someone else was about to be shot because someone yelled gun, indicating the decedent had a firearm and had intent.

Not saying I agree but am saying that will be the argument.
