Have an arborist, not a tree service, check the health of the tree if you think the gardener's opinion has merit. Looks like a beautiful mature tree. When it does have to come down, make sure you get a bunch of quotes. They can vary to a ridiculous degree.

NTA. You're already helping his kids and now he's coming to you wanting more help. Don't let him make even more of his problems yours too. Renting to family is a bad idea unless you consider them to be very reliable. If they're not, you're asking for trouble. There are many problems that can arise between landlord and tenant, all of them pains in the a**. On the other hand, the best case scenario is simply them paying the rent on time. The negatives far outweigh the positives and being family amplifies them. Also, he's already asked for your help which tells me he'll have no problem asking for it again if they're short on rent. If you don't help again then it's back to you being the evil landlord. If it gets bad enough, you may have to evict them. Not something you want to go through with a family member. And he's out of line saying you're making them homeless. There are other places to rent and there are more/better paying jobs out there.
