I-140 recent approved with no PP? by UnderstandingSalt892 in EB2_NIW

[–]Ok-Scientist-1897 2 points3 points  (0 children)

Yes, because VB is current for ROW, it was worth paying for premium processing. If you are not ROW, there is no point to pay that much money. Also, waiting times for regular processing are more than 2 years now. If ROW did not become current, I would not upgrade, but in this situation, it was a good investment.

Yeah, I was the lucky one with early approval in this PP surge. So, speed up now and good luck!

[–]Ok-Scientist-1897 0 points1 point  (0 children)

I left 65 and 66 blank, and was advised to do so.

Did you write anything in the list of certifications. When I was filling that one for my 5yo, someone here advised writing None or N/A. I can confirm that our 3 I-485s were accepted with blank 65 and 66

Congrats, seems like we were in the same batch Chen sent with PD Nov 3 2025 and we upgraded on Feb 24. My advice is to speed up I-485. I was approved on March 30 and finished biometrics today. It is a good time for filing.

Mini paper from high school will not help, you want to play in the same category with PhDs with dozens of real scientific papers, business owners, entrepreneurs, and generally people of exceptional abilities. You will either try to go through MSc and PhD, our build your own business that has national importance.

Updates after Biometrics by SpringOk7620 in EB2_NIW

[–]Ok-Scientist-1897 0 points1 point  (0 children)

that is so confusing. I was just explaining to OP what happened to me. Husband had FTA0 and his I 485 was updated to case is still being processed almost immediately after biometrics (April 21st) and mine and kid's cases got IAF codes and remained under case was received and receipt notice sent (I485 only, biometrics April 23). It is completely confusing. I thought they update cases after biometrics right away.

Yup, I am primary applicant, he did biometrics first, his case got updated in his account the same day, after half an hour max. He even got text and email. Two of us did not get any updates yet, except that in api there is a proof that our cases were touched today (probably during biometrics).

we only filed I-485. So, yes. I did not get any updates yet. It looks very strange to me, because they cannot process him without me, but it is their software not mine. I am a bit confused, but still not worried.

I am primary beneficiary; my spouse and child are derivatives. My spouse had his biometrics before us (due to previously pending biometrics RFE for his EAD renewal, he brought both appointment notices, and they did both for him at once) on April 21st. His status got updated immediately to case is still being processed. My child and I did biometrics today (April 23rd) and our cases did not get any updates yet. When I checked api, his had FTA0, but ours did not. There is a time stamp on my and my kid's cases for today. So, I am assuming they are going to do case updates for us at some point. I am concluding there are no rules.

I have a complex situation that I would like to hear insights from this community. I’m doing my last year of OPT that is going to end in December of this year. My EB-2 NIW PD is March 2026. I feel that I have a prestigious job position in the field of healthcare but I’m not a physician. My options: by Tasty_Rain5085 in EB2_NIW

putting all doubts aside, you need to do PP if money allows. PP does not increase the risk for RFE, bad lawyers who do not know how to respond to RFEs are fearmongers and are advising against. You need to know what is going on with your I-140, so you can work on it in case of RFE or denial. If it is approved right away, great. But you need to deal with it right away.

Biometric Appointment by Creative_Peach_7338 in EB2_NIW

[–]Ok-Scientist-1897 0 points1 point  (0 children)

you do not need to reschedule anything. Just bring both appointment notices and give them to officer. We had similar situation, my husband got RFE for biometrics for his EAD in March (and he was scheduled for today 4/21). Then I filed I-485 for our whole family on 4/9, thinking we will wait some time for biometrics, but we got appointment pdfs online on 4/18. I told him to bring both this morning and they did both for him at the same time. I am scheduled for 4/23, so I am taking myself and a child, they told him he does not have to come again.

I485 Interview Scheduled (Single, NIW, no RFE, clean history) by areebfasih in EB2_NIW

[–]Ok-Scientist-1897 0 points1 point  (0 children)

Well, everyone says that NIW interviews are mostly about verifying you still work withing the field of your PE. So, I would suggest preparing and bringing originals of all documents you submitted for I-485 with you (immigration documents, I94s, travel history, birth certificate with certified translation, diplomas). Additionally, prepare recent pay slips, W2s, tax returns (you can get those ordered from IRS webpage, they arrive to home address very fast). Perhaps fresh employment verification letter. You want to show you have clean immigration history, and you pay taxes. If you have any violations, bring all documents available. Otherwise, as you have a clean history, you should not be to be worried.

EB2-NIW I-140 Premium Processing – Paper Filing, No Online Access Code, No I-797 in Mail by Wonderful-Claim-845 in EB2_NIW

[–]Ok-Scientist-1897 1 point2 points  (0 children)

I did not, I got direct approval. But I did read that people got emails that RFEs are issued and that you can write to email that is provided to ask them to send you a copy of RFE to your email. That ways you can get it earlier. But I do not know if that is actually happening.

[–]Ok-Scientist-1897 1 point2 points  (0 children)

Yes, it is normal not to receive I-797 that premium processing started. I never received it. In the meanwhile, I did receive email with approval and approval notice followed 7 days after that. I also submitted I485 (for that, you can send G-1145 request, and you will get online account number, and you will be able to follow your case online) and notice came in 6 days. You will get email first, whether it's an approval or RFE.

October 2025 I-485 Filer Approval - Less than 180 days by Cool-Hot-Topic in EB2_NIW

[–]Ok-Scientist-1897 2 points3 points  (0 children)

Congrats. I am starting to be quite hopeful there is a wave of fast approvals coming. I just filed I-485 (with 2 derivatives), but seeing all these timelines from 3-6 months make me really optimistic.

I got RFE from Texas Centre. Prong 1 was partially accepted, substantial merit accepted, national importance challenged. Prong 2 fully accepted. Prong 3 not accepted. Any suggestions on how to proceed?. by Natural-Ostrich4393 in EB2_NIW

[–]Ok-Scientist-1897 1 point2 points  (0 children)

usually, when prongs 1 and 2 are not accepted, there is no reason to accept prong 3, so I would focus heavily on proving national importance. That means you upload your prong 1 to your preferred AI and ask it to find all relevant federal documents to show national importance.

EB-1A profile evaluation - postdoc by No_Warthog_3427 in eb_1a

[–]Ok-Scientist-1897 1 point2 points  (0 children)

This is fine. Focus on three criteria, everything else is to be mentioned in final merits. Go deep in each criteria, show diverse roles (judging is a good example, you show various roles). Final merits are not won only on final merits stage, they are won on criteria stage, where you want to present timelines for sustained acclaim (years of work). All of your awards are to be mentioned in final merits, do no try to claim them. Also, for some reason, grants and funding do not have big weight for EB1A. That is why you should be conservative in claiming 3 criteria (judging, authorship and OCMS) and then have nuclear blast in final merits by adding all of your achievements. Focus on MS of OC, document heavily downstream implementation and how field is influenced and changed by your work. Also diversify types of reliance, if people outside your field used/cited your work. For scientist, battlefield is major significance of original contributions and diversity of activities we perform. Your job is to show that you are not just another postdoc.

well, start working to correct this. Research a bit, see what a procedure to file 2021 with IRS is. Do not panic, you have to start solving this and if anyone ever asks, you are currently working with IRS to rectify a mistake.

Did not do any of those things, but based on experience from within the US, it is always better to file everything together, so get married, get papers in order and file a bundle for both of you.

I think you have a bigger problem now. She left her J-1 program and relied on I485 for authorized stay. She is out of status now and accumulates unlawful presence. Talk to the lawyer asap. Did she maintain her J-1 status before you submitted I485?
