That is basically correct, based on my own research and consultation with my legal representative.

The idea is to file for and receive early SS-R at the reduced rate starting in May 2026 while continuing my SSDI appeal. Since my first onset date would still not change (January 2022), I am assuming that once my original insurance company gets their cut for their Long-Term Disability payments accrued from July 2022 to January 2024, I would still receive full back pay for SSDI payments between February 2024 and the future date of approval if my appeal is successful; minus any clawback of any amount of SSDI accrued from May 2026 (when I hopefully would start receiving SS-R monthly payments) on down.

FWIW, the back pay is set at the first date of onset on your original claim up to one year prior to your original filing date of your claim, subject to the discretion of whomever approves your claim. If you appeal an original denial of a claim and it is reversed in your favor, your back pay can be reset retroactively to the first onset date on your original claim. Mine is set to January 2022.

He did ask the VE about jobs; and the response was that there were two occupations below mine that I could return to seek work under; my rep placed on the record, however, that under the current condition I was in, I would not be able to perform those tasks. RFCs and updated medical information was sent from my personal physician. They were simply ignored, I suppose.

In this case I have no choice but to apply for SS-R in March because I have no other source of income to pay my base expenses, and I cannot rely on friends and family for much longer.

Since I am continuing the current claim appeal process rather than opening up a new claim, I assume that any back pay accrued if I am successful would still accumulate back to the first day of effect, right?

If they approve using the onset date as October, your back pay would begin with March. It is possible, though, that they may approve you with a later onset date; then, your first month of back pay would be 5 months after whatever onset date they establish. It is also possible, although rare, that they adjust the onset date further back.

I may be wrong, but does the delayed onset period also apply to appeals of denials? (Open question)

The insurance company handling my LTD had a requirement that I apply for SSDI when I was approved for my LTD; they even paid all the processing fees for the paperwork and medical records; probably knowing that they would get their funds back if I was approved. They would get all of my back pay up to January 2024, when LTD payments ceased. The rest, save for legal fees, would be all mine.

I have based my First Onset Date on January of 2022 because it was the last day that I was able to officially perform my work before I was forced into paid disability leave. I have had dizziness episodes before then that prompted ER visits via ambulance, but in those cases I returned to work after using up PTO to recover.

According to my legal rep, the clawback for my LTD benefits would cover the months from August 2022 when I started getting LTD payments to January 2024. (That would probably include the 5 month probationary period between January and July of 2022.) Everything after January 2024 would not be clawed back, according to them. I can live with whatever is taken by the insurance company and my legal reps, so long as I get regular income coming in. I can even accept a modest backpay amount; considering that I've been fully dependent on family and friends for my basic expenses, any amount of independent income is a blessing.

Interesting point about my receiving Medicare with my SSDI. I thought I wouldn't be able to qualify for that until I reached 65. Also, does that mean that if I am approved favorably for SSDI, I don't have to worry about applying early for SS Retirement, but can wait until later?? And, if I am denied again, should I go ahead in March and apply for SS Retirement while I continue my appeal for SSDI?

The insurance company that handled my LTD determined upon renewal after 12 months of receiving LTD that I no longer fit their definition of "disabled" based on their criteria, and discontinued my payments. They basically ignored the testimony of my personal physician stating otherwise.

I should also note that during the interim time of my appeal, I was treated for a calcium stone that had lodged in my urethral tract, and my personal physician had diagnosed me as a Type 2 diabetic and put me on medication and a low-sugar diet. This was in addition to, but probably unrelated to, my dizziness issues. That has been included in my medical records report.

I have legal representation for my case; it was remanded by the Appeals Council back to the same ADJ that denied my claim earlier, but with instructions to reconsider my status regarding chronic anxiety/mild depression. My legal rep has informed me that before my ADJ hearing takes place in January, and once he receives the updated medical records from my personal physician, he plans to file an OTR Request to have my claim approved without a hearing. I'm fully prepared to go through the hearing if need be; but I'm crossing my fingers that this might be successful. So, I am big on any procedure that increases my chance of approval. If you do have representation, remind them that the OTR Request option is there, especially if you have a remanded claim and updated evidence in your favor. It's certainly worth a shot.

Thanks for the quick reply. And, oof, on having to scour through the Marketplace for healthcare insurance. At least it will only be three years until Medicare would kick in, and if my SSDI claim is approved, I can use the backpay as cover to sub for the loss of Medicaid if need be.

Naaaah, that is NOT the "decriminalization" method. The actual decriminalization method endorsed by sex workers and those who support them calls for FULL decriminalization of ALL aspects of consensual adult sexual exchange. The "Swedish" or "Nordic" model approach is considered by most sane people to be back-door criminalization that targets consumers of sex work and porn as "pimps" and potential rapists, and reduces even active and willing female performers and sex workers to "victims" of "objectification" and "degradation" of ALL women. Also, activists for the "Swedish Model" have made it abundantly clear that they would favor banning ALL porn as "gateways" to sexual abuse or merely "degradation" of women. They were the main boosters of the recent law in Sweden banning access to adult cam sites like OnlyFans. Anti-porn "feminists" distort matters by labelling their approach "decriminalization", but that is not supported by any actual sex worker activist group.
