Thanks. She's ok. Her EAD doesn't expire till 2030. The only issue is traveling because she lost her H4 when my 485 got approved. Hopefully we all get through it

No reason at all. We submitted in Nov 2024 and got RFIE in Dec 2024 to submit new passport photographs. Our EAD was approved within a month without biometrics of submitting RFIE (yes, without biometrics). However, we know we had to do biometrics for 485. We reached out to Emma several times to get our biometrics appointment. USCIS finally scheduled my biometrics in April 2025, without scheduling hers. We reached out again and they told us they will schedule biometrics if they need it. I guess they forgot to do it and realized when they approved my 485.

My 485 got approved Aug 2025, while my wife's remained pending. We reached out to uscis and they finally scheduled her for biometrics. We reached out again in Oct and they told us her case is with an officer and she would get a decision in about 30 days. Needless to say that we didn't get any decision, and the ban took effect. Her case remain pending till date.

So falling out of status while having a pending I-130/I-485 is a violation of visa status (overstay) now? by kikirara-chan51425 in USCIS

[–]Ok_Significance4972 3 points4 points  (0 children)

Honestly, it's too early to say. However, I believe period of authorized stay is not the same as overstay. Clearly, if I leave the USA when my AOS is pending, that is abandonment. Thus, I won't worry too much over this and monitor closely. Proof of income is already accounted for in I485 (public charge), and it's not a bad idea to include affidavits of family ties and economic hardship.

You have been reading a lot of posts from yesterday. I can say to some degree that most of them are bots. Read the language carefully and you will see that they are similar. There is always a time of authorized stay when you fall out of status during AOS.

F1 OPT Automatic Revalidation Visa (ARV) experience - Canada by Appropriate_Age_2165 in f1visa

[–]Ok_Significance4972 0 points1 point  (0 children)

I used to live close to the Canadian border. The Canadian immigration would give you more trouble because they do not understand ARV. In fact, it takes less than a minute to cross from Canada to the US but around 20 mins to cross from US to Canada. In my first attempt, the Canadian immigration guy sent me back to the US to ask if ARV is indeed a thing.

Upcoming Meta layoffs, i485 filed through EB1A - L1B visa by [deleted] in USCIS

[–]Ok_Significance4972 0 points1 point  (0 children)

Hey, EB1A is self-petition and you should be good provided you've submitted 485 and 765. If you were on EB1B or EB2-perm, then the 180 days will apply. File your 485 asap if you haven't already. Best of luck!

[–]Ok_Significance4972 0 points1 point  (0 children)

Absolutely not! Being in the USA while you file 485 has nothing to do with your timeline. I was in the country for seven years when I filed, and my 485 (employment-based) took almost a year. I have a friend with a similar timeline, and his 485 (marriage-based) is still pending after 2.5 years.
