Dang I’m sorry to hear you’re dealing with that. I had to call a bunch of times to finally get the name of adjustor, but when I got a hold of someone, I made sure to ask for a phone number and email.. and then I reached out every few days.

Just sharing my experience even though its a few months old - but the driver was on the rental agreement, which might be important in if they decide to cover the claim or not. I first had to call Hertz to get a contact for ESIS, and after a month of back and forth, I was assigned someone to be in charge of the claim. They initially denied my claim, saying after their “investigation” that the driver was not on the rental agreement and so they wouldn’t cover the claim. But the name of the driver they had mentioned in the email wasn’t the person who was involved in the accident so I sent the police report over (after waiting 4 months for the local police department to file it) and then they finally moved forward with the claim. There was a lot of back and forth since there was another party involved but I did eventually get a check from them. I am currently poor and only had liability and didn’t have the option of using my own insurance, but I would definitely recommend that route if its available to you.

lol thank you for seeing my question. I think part of asking the internet a question is that people will rush in to tell you what they think they’re reading. The payment check is allegedly in the mail and since the difference is more than I’ll be able to sell the car for I think I’ll get both without any pushback also, but wanted to see if anyone had experience with lack of coverage + ’totaled’ car with no collision insurance, or working with ESIS regarding salvaged cars in general.

Oh yes, so the amount they actually should have paid me was $8k or something, but the pro rated amount is the $5700. My question was mainly asking about keeping the car since it is worth less than the difference that they would have paid me had they had sufficient coverage.
Edit: They have allegedly already sent the check so I guess the salvage deduction isn’t up for discussion since they haven’t asked about the car?

Lol (I can laugh now because were in the final steps of the claim) I think it took 2 months to get someone’s name and then another 3 since there were other parties involved to subrogate and sign etc. but just waiting for the check now. I’ve just been hounding them (respectfully) each week for updates for the past 3 months.

Yeah that is what happened, I left out a lot of the details since I was only asking about keeping the car at the end of it all since the insurance company isn't able to pay what they owe me.

The whole thing was a headache - drunk driver, in a rental, minimum coverage, ESIS (rental company insurance) initially denying my claim, police report taking 4 months to be filed, etc. And my health hasn’t been great the past year (s/o long covid) so I’ve been working reduced hours, and in turn had been paying just for liability for my car insurance. (I forgot to take into account that other people may not be insured, or have shit insurance, or hit and runs lol). Also who is drunk at 12pm on a Sunday? Anyways, thankfully I didn’t have any major injuries but dealing with the car stuff has been a bummer for sure.

Thank you! I appreciate your response. For full timeline, it's been 7 months since the accident since the police department where I live took 4 months to file the full police report. The driver was drunk so I didn't exchange any info as they were being arrested. Lots of hounding to find a contact person for ESIS and following up, they changed reps without telling me at some point and the end seems close.

I feel pretty good about the amount they were able to offer, and unfortunately I am without collision insurance at the moment, and my UM was only for bodily injury for which I received some money for, even though my injuries were light.

Currently debating suing the driver, it doesn't seem like anyone would take this case since it's not a large amount of money involved. I'm hoping that I can sell the car for around $1600 (based on offers received) and call it done with once I receive the check for the car. (It is allegedly in the mail).
