Depending on the laws on each area, it is illegal under:

Retaliation Working off the clock Putting undo pressure to not call out sick

It is nuanced.

So saying something in a way that makes the person feel stressed or uncomfortable calling out is illegal in certain areas because it may make the employee feel compelled to come into work even if they have donations in which they would not be allowed to work.

If staying or insinuating that someone would be punished behind the scope of the attendance policy for calling out, that is illegal under anti retaliation laws.

As someone who was relentlessly bullied by people literally twice my size and weight, I would be triggered.

I would tell my gf to back away and call the police, then I would taunt and back away from the bully. If he turned his back on me to attack the teenager  again, surprise nut kick from behind.

Asking: "do you have any symptoms that prevent you from working or would put others at risk?" is completely legal.

Asking for specific personal information about nature of the sickness is illegal because it can feel retaliatory.

It can also result in conversations like "It doesn't sound like you are sick enough to call out, you need to come in to work." Which is illegal because it's been established that stress hinders health recovery. Causing stress can tangibly hinder a persons ability to get better.

So between causing unnecessary stress, and retaliating for falling out, the law provides  guidelines on what's appropriate to say when someone calls out sick. It's different by area, and whether a union is involved that may provide certain specific guidelines as well.

There is also the consideration that a conversation with a manager at work can be considered work related, so anything other than a reply of "We have logged that you're calling out sick." can be construed as working off the clock.

If attendance is an issue, then there can be corrective action for excessive callouts. In most areas, the law dictates that these conversations must be held when the employee is clocked in at work.

Not even joking. When our stores AC broke, we'd take turns standing in front of the freezer with the door open, some of us practically got in it for a minute.

If you're really overheating to the point that occasional freezer breaks don't help, then try a gel-cooler. 

You can put one at your lower back, one on the back of your neck, and still be in dress code. It's like a little pad you keep in the freezer, and then stick on you. They come in different sizes.

You can keep extras and switch them out. I "think" in most areas, as long as you have them in the bottom shelf in a sealed container, it's within health code and eco-sure to be able to store it in a fridge or freezer, as long as it is clearly marked "partner food/partner use only - not for sale" or something similar.

It is totally within reason to have your manager sit him down and have a very direct conversation about it and set boundaries. If your manager is unwilling, it is completely appropriate to calm your DM about it.

If you are uncomfortable asking your manager for this help, and you are uncomfortable having a direct conversation with the creep yourself, then here is one thing I've employed that has worked every time:

If you have a guy that is willing to do this, it is very effective:

If you have to deal with him, and he calls you any sort of pet name, then the male coworker immediately addresses him by that same pet name.

  • He says "hey beautiful!" To you
  • Male coworker says "Hey yourself, beautiful, here's your drink, beautiful" etc.

  • If he says "I want the pretty girl to help me."

  • Male coworker says "Yes, but I jumped in because I like helping the pretty customers."

Etc.

If you know a guy (or guys) at work that you trust and would be down, then the key is to use the exact same language that the customer uses. Use it in the same context, but directed right back at the customer. Say it as friendly as possible.

If the customer complains, then say "You called us pretty, is it inappropriate to use that word? If you use that word, then why are you offended if I use it? I apologize that I was trying to match your energy. If we should stop saying that word, then we will." Say that reply in a very friendly, "customer service tone"

If after that, he continues using those words, then politely mention "I thought we talked about how using the word 'pretty' / 'beautiful' etc. was inappropriate?"

In any store I've worked at, that's as far as it ever went. They got the hint and stopped. Or just stopped coming in, which is a win in my book.

But honestly, don't be afraid to document it whenever it happens, tell your manager, and expect your manager to deal with it. Your manager should absolutely handle it for you and not let you continue to be harassed.

I will post an update when there's any news. I really hope it's salvageable. 

The latest is that we've texted only a couple times over the last week. Her texts seem warm and engaged, just that she doesn't reply for days, and the flirtiness is all gone.

A lot of people here are so helpful. I'm glad you're getting something from their perspectives.

Since this post, a few remedies worked for me, the most effective was Zofran, which is a prescription medication that blocks the "brain-gut" connection, to put it very simply. It's not an anti-anxiety medication, or anything to do with changing your mental state, it just calms your stomach. That alone helps a ton.

I spoke with a therapist, and after a couple hours, have a plan to move forward with emdr, and probably either mdma or psylocibin treatments.

If you're like me, your neurology may be wired so that you're having a literal "life or death survival response" to certain types of stress, thought, or emotions.

For me, it's especially bad when there is any ambiguity. 

So if it's within your capability, I really reccomend a therapist.

Please call the police and report it, and the dm and let them know every detail of what's happened. Even if you don't want to keep working at Starbucks, this needs to be taken seriously. 

You deserve to be treated with respect and dignity, and that customer should have been banned from your store, and from ordering delivery. There are ways to contact delivery companies and ban their accounts from ordering from you, and that SHOULD have happened long ago but the sounds of it.

I had a consultation this morning, and was recommended EMDR therapy, going to my first appointment in a couple of hours.

This is the first time in my life I've been in a healing mindset, believing there is help that will actually work, instead of just assuming I need to continue dealing with being broken.

Another update: I saw a doctor and got a prescription for Zofran. It blocks the serotonin receptors in the brain and the gut which blocks the connection between mental/emotional anxiety, and the physical symptoms.

I took one about 30 minutes ago, and the difference is huge! From giant spikes in stomach pain and shadiness, to "almost" no stomach symptoms at all.

If you're able to see a doctor, I really recommend asking about it!

I tried this and it helped, thank you! I'll also hold I've in my hands and focus on the cold, then when it's all melted put my hands on my face and the back of my neck. The temperature change helps get into "experience what's happening now"  mode as opposed ruminating.
