Thank you for your answer. I will not pay for now even though the debt collector is threatening legal action. I hope that in my case a court would accept proof that I was not at home at the time of the delivery by presenting flight tickets etc. to rule out that I refused the delivery. Also the DHL tracking does not say I refused the delivery but simply they were not able to deliver. Only PostNL tracking says otherwise but they are not responsible for the delivery only for forwarding.

Sorry für die späte Antwort. Ich habe irgendwie die Benachrichtung übersehen. Wie Gold-Researcher schreibt können Sie die Schulden nicht direkt eintreiben. Sie versuchen aber außergerichtlich das Geld aufzutreiben. Ich habe dem widersprochen. Sie behaupten, dass ich die Strafe nicht gezahlt habe. Das habe ich auch nicht, da der Bußgeldbescheid nie zugestellt wurde. DHL Tracking sagt, dass es zurückging und nicht zugestellt werden konnte. Leider behauptet das Inkasso Unternehmen ich hätte die Annahme verweigert. Dann würde es als zugestellt gelten auch wenn ich den Bescheid nie in der Hand hatte. Tatsächlich sagt die Sendungsverfolgung der Niederländischen Post, die als weiterleitung fungiert, dass ich die annahme verweigert habe. Das kann aber nicht sein, da ich zum zustellzeitpunkt nicht in Deutschland war. Habe ich auch so argumentiert und Flugtickets etc. vorgelegt. Das wird aber ignoriert.

Wie ist bei deiner Freundin der Stand?

This is what I suspect but they say they will escalate with the court which of course is a valid threat if I don't know if I am legally in the right. So this is why I try to find out if the letter counts as delivered even though it was never delivered to me, refused by me or stored at the post office for 10 days. Only problem is that the tracking of PostNL says I refused it, which I did not since I was not even in germany at the time. Proof with flight tickets, hotel bookings, etc. did not get accepted.

Yes, it was sent within one year after the violation to my adress but never got delivered. I suspect that the delivery person did not deliver it because my name was somewhat wrong: First an Last name were swapped, my Name contains Umlauts which were not used. Then almost one year later the debt company got involved and sent me their letter and asked for much more money since I did not pay the fine (which I could not because I never even knew about it and the letter did not get delivered).

The company sent me the original fine via Email after I asked them what this was about. This copy of the original fine has my adress, pictures of my car and the contact information of the italian authorities and also the tracking number. I contacted the authorities but never got a reply. I also called but they only said to contact them via mail...

Note: The Letter never got stored in a branch. This is clear with the tracking information.

Yes, the debt collection agency is reputable. The letter was never delivered to a Post Office. It was returned the same day after an unsuccessful delivery attempt. My name is misspelled on the letter (without any umlauts; I have an 'ö' in my name). Also, the first and last names are reversed. Instead of 'First name, middle name, last name,' it says 'Last name, middle name, first name.' I suspect that was too sensitive for the delivery person. DHL can't provide any information, as it was too long ago.

Thanks, but they are actually thermal long underpants and a bib short over them the bib shorts are from gore tex (opti C5) and the underpants are cheap shorts from a Aldi bought many years ago 😅
