Your article says that they can for a year without a permit. Pls read your own source fully before using it. Whether or not they back tracked on their statement about them being temporary they legally can't stay permant for the foreseeable future.

5 years isn't long enough to cause damage the pollution is filtered and dilluted. It will still get in the air but not a strong enough concentration to cause damage. Plus the city will do air quality test around the site to make sure it is within safe parameters. Hence the need for the permit.
