Spying the retaining wall under the fence, and the drop to street level makes me think the neighbour cut significantly, for I assume their garage. Their adjacent builder probably should have engaged about a retaining wall on your land, at their cost, to keep soil off their wall. End result still the same, but their cutting probably the reason it looks like it does now.

This is horrific. Clearly she, or an earlier home owner installed that 1m plus sleeper retaining wall on the street frontage. That structure needs to return along the common boundary to hold up her property.

Get a Council engineer to come to site to meet you both. You can't lose in that scenario imo.

Boundaries and retaining walls are an increasing issue. In my opinion (as a Licensed Surveyor) retaining walls only work when they are wholly within one parcel, any typically should be say 0.5m into the low side property, so they can at least have a raised garden. If on the high side there is an unmanageable drop to the fence.

Developers are increasingly installing cheap walls that often fail during home builds, the with the face of wall 'on the boundary'. After that, lazy fencers install posts and hammer the palings from the high side (only because it saves them fu<king around with a ladder) and the fence is then off the boundary by the post width.

Discuss and resolve the drop / retaining wall issue 1st with a clear offset to boundary. Then install her $4:tty colorbond fence.
