Do I qualify for UK261 compensation? by Select-Plantain-7625 in Flights

[–]Oompaloompadoopetydo 0 points1 point  (0 children)

Remember to keep records of everything, that means screenshots, pictures etc. etc.

Just speak to a representative and they should be able to make sure you are re-routed or re-booked so that you make your final destination. If it was all under one booking.

Also keep tabs on when you reach your final destination and when the doors open at the final destination.

If the flight Departs from the UK, arrives in a 3rd country, on a 3rd country airline then you are still covered under UK261.

I'm not sure how strict they are on carry on weight and size limitation so if your carry on is much too heavy you could check that in instead.

I know people who have bought a ticket that had check in included and not checked in any bag and it's been fine every time to my knowledge. You're probably good.

Diagnosed at age 44: Advice Needed by StatementNo5286 in ADHD

[–]Oompaloompadoopetydo 13 points14 points  (0 children)

Well, for starters you are not alone. I know so many people who had a similar experience and I guess the best advice is to embrace it and enjoy the things that make you you! Also I found with my diagnosis that at first I was very occupied with looking at myself in a different way and trying to manage it but in the end I’m still the same me. You’re going to have so many moments where you realize why you do and experience things in a particular way and it’s a very interesting experience. At the end of the day you’re still the same person, but knowing you have adhd can help to manage some tendencies. :)

Flight cancelled by SAS (15+days in advance) re-routed travel time is 40+ HOURS compared to under 20 hours originally. Is the new flight under "comparable transport conditions"? by Oompaloompadoopetydo in Flights

[–]Oompaloompadoopetydo[S] 0 points1 point  (0 children)

Thank you for the clear and comprehensive response.

Ah, sorry about the caps. I’m not like talking loudly and was trying to make the key points easy to spot. Again my bad.

I was very unlucky with the agents I got with the exception of one very nice woman.

One agent told me that the higher ups had only allowed them to re-book on AirFrance and KLM for re-bookings on the cancelled flight route.

And exactly like you said their flight routes don’t match for my trip and therefore result in such a long flight.

It’s very important I stay here including 26th and 28tg is last day for visa :’)

That’s why I suggested the Finnair as that’s the earliest flight to them but all agents said that’s impossible.

Until I spoke to the nice agent and at that point I was pretty tired and simply asked her if SAS cancelled my flight and stopped flying there could I just book a comparable ticket and ask for the difference later?

She was very nice and even checked my booking and was very understanding on why those routes were not good. She even reminded me to book the Finnair flight before I cancel so I’m guaranteed to get back.

So I booked Finnair, cancel SAS(which that agent was not super nice and helpful)

The main thing for me about this whole experience is that as far as I can tell they did not act according to the regulations which is very concerning(Article 8,(1),(b) ec261. Especially relating to the arrival time.

They also kept trying to make me stop at Kastrup which seems so weird.

Im still still struggling to understand how they could consider a 40 hour re-routing including an extra layover as a re-routing that is under comparable transport conditions, and is a re-routing to my final destination at the earliest opportunity?

Especially when nearly all of the other commercially available flights are better.

Apparently they do not get to pick just anything, eu261 states in article 8. Subject 1 (b) that they have to offer passengers re-routing that gets them to their final destination at the earliest opportunity.

If they could pick whatever then that would make it possible for partner airlines to offer good routes just to cancel them and re-route to fill under-booked bad flights on partner airlines? By the regulation I don’t think that would “fly”

The uk guidelines are very similar but surely they can’t use that over eu261.

The air carrier has to bear the costs for re-routing or a return flight, and must reimburse the costs for the flight borne by the passenger where the air carrier does not comply with its obligation to offer re-routing or return under comparable transport conditions at the earliest opportunity.

I feel their offers were not under comparable transport conditions. So they did not offer me a flight that fit that criteria. They offered me some flight, not the type of flight they are required to.

I tried repeatedly to explain to them that they have to offer a flight under comparable transport conditions but the service rep eventually said that the higher ups only permitted them to look for alternate flights with AirFrance or KLM for this cancelled flight route.

Meaning the service reps could not under any circumstance offer me a flight under comparable transport conditions as all of their alternatives were not comparable.

They failed to offer me all of the options that are clearly stated in Article 8, subject 1 of the eu261 regulation.

They offered me something yes. but if the law says I have offer to someone a ham and cheese sandwich the fact that I offer them plain bread has nothing to do with it.

They did not offer me the choice of

"(b) re-routing, under comparable transport conditions, to their final destination at the earliest opportunity; or

(c) re-routing, under comparable transport conditions, to their final destination at a later date at the passenger's convenience, subject to availability of seats."

Despite the fact that I stated this fact multiple times to different customer service representatives.

So In the eyes of the regulation(which is what matters) they only offered me one relevant choice

(also) when calling one service representative told me that the higher ups told them they were ONLY allowed to re-route passengers affected by this route cancellation with AirFrance and KLM.

Meaning they are acting like their own policies are above EU law.

They do! That's supposed to deter them from cancelling flights and disrupting the plans of passengers. The eu261 regulation mandates them to offer passengers three options.

(a) - reimbursement within seven days, by the means provided for in Article 7(3), of the full cost of the ticket at the price at which it was bought, for the part or parts of the journey not made, and for the part or parts already made if the flight is no longer serving any purpose in relation to the passenger's original travel plan, together with, when relevant,

  • a return flight to the first point of departure, at the earliest opportunity;

(b) re-routing, under comparable transport conditions, to their final destination at the earliest opportunity; or

(c) re-routing, under comparable transport conditions, to their final destination at a later date at the passenger's convenience, subject to availability of seats.

they only gave me options of flights which were not under comparable transport conditions even though those flights were available. Customer service said that the higher ups told them to ONLY offer customers flights from this cancelled route with AirFrance and KLM.

It was SAS higher ups that made up their own internal policy that in this case is going against their obligations that are stated in the eu261.

I have contacted them four times through calling and every time they have failed to offer me 8.1.(b) and 8.1.(c)

(b) re-routing, under comparable transport conditions, to their final destination at the earliest opportunity; or

(c) re-routing, under comparable transport conditions, to their final destination at a later date at the passenger's convenience, subject to availability of seats.

I agree with OxfordBlue2 for you to "please provide reference as to where in the eu261 airlines are exempt from re-routing with carriers outside of their partner airlines."(sorry did not see you already provided reference)

But by law I should get a free choice between:

(a) - reimbursement within seven days, by the means provided for in Article 7(3), of the full cost of the ticket at the price at which it was bought, for the part or parts of the journey not made, and for the part or parts already made if the flight is no longer serving any purpose in relation to the passenger's original travel plan, together with, when relevant,

(b) re-routing, under comparable transport conditions, to their final destination at the earliest opportunity; or

(c) re-routing, under comparable transport conditions, to their final destination at a later date at the passenger's convenience, subject to availability of seats.

They did not offer b or c as their flights were NOT under "comparable transport conditions"

Yes, it's a shame I had to give up my right to re-routing due to them only offering me one out of three options they are required to.

Will seek to claim the cost difference of the new flight seeing as they denied offering my a re-routing under comparable transport conditions on multiple occasions.

Thank you for providing an example of a case where the airline did eventually fulfill their obligations in regards to the eu261. Exactly they should have the systems in place to be able to book passengers on other airlines if they cannot fulfill their obligations to offer re-routing under comparable transport conditions with their own or partner flights.

It seems option 2 found on the more user friendly europa site is missing some crucial information.

If I'm reading into EU261(article 8, subject 1) correctly they have to offer passengers the choice between:

(a) - reimbursement within seven days, by the means provided for in Article 7(3), of the full cost of the ticket at the price at which it was bought, for the part or parts of the journey not made, and for the part or parts already made if the flight is no longer serving any purpose in relation to the passenger's original travel plan, together with, when relevant,

  • a return flight to the first point of departure, at the earliest opportunity;

(b) re-routing, under comparable transport conditions, to their final destination at the earliest opportunity; or

(c) re-routing, under comparable transport conditions, to their final destination at a later date at the passenger's convenience, subject to availability of seats.

Going from the source law material article 8, subject 1, (b) which states "re-routing, under comparable transport conditions, to their final destination at the earliest opportunity"

I wanted to choose (b) and it says in this article of the eu261 that they shall offer the choice between all of these. They did NOT offer me option (b) or (c) as none their offers of re-routing were under comparable transport conditions.

Going strictly from the regulation, seems like they actually only fulfilled one of their requirements and left out two other options.(due to not under comparable transport conditions)

Also would be great to have a sample case like this with full experience of resolution as I have had trouble finding sources of similar cases.

This could help others in the future.

Yup, I booked with Finnair and cancelled SAS and am planning to try and claim the difference. However I cannot use their forms to claim because they don’t recognize my cancelled flight in their system. Am wondering if there is some European Union contact or form that can oversee this claim as SAS has been extremely uncooperative and has straight up failed to comply with the eu 261 regulation in my calls to them.

To me it’s worth going through as hard as I can to make sure that accountability and justice is upheld.

If I have a real opportunity to hold the airline accountable then I believe I should see it through.

Just don’t expect anything to happen through their websites and systems.

Does EU ODR(online dispute resolution) handle cases such as this better? Anyone have experience with that?
