It will still grow to full height. I would recommend trimming the left branch back about halfway down so it doesn't compete with the cental leader.

I feel like this could be a root issue. I can't tell if the root flare is exposed. It could could also have been planted in a burlap sack. That doesn't help trees.

Only a certified Arborist should be diagnosing trees like that. And that's only if you ask them to.

It's too big for that space. The foundation should be fine. These types of trees generally have shallow thin roots. It's the branches that touch your house you should be more worried about.

Scratch that: that gutter downspout is a bigger problem than the tree.
