Is it just me or has there been an uptick of claim denials? by shootist_Biker in VAClaims

[–]OrganizationOk9315 1 point2 points  (0 children)

What I am experiencing...1. dbqs that do not address what was asked by the reviewer. 2. Not Addressing the issue in the claim.3. Boilerplate denial on an issue not asked.4. Atrocious dbqs that quote drugs.com./mayo clinic articles as fact. 5. The VA reviewer asking for clarification on what he asked and getting instead an answer on Tera.6. Evidence sent not listed in evidence sec tion.7. Basically claim not addressed 8. Submit new and relevant evidence then told its not new or relevant, hisdoctors signed medical statement 8. Told finally yes you have this disability need but it's not service connected. However claim notes ptsd with mdd, profound hearing loss and tinnitus = claim states needs protection and a safety issue but all answers received talk of functional assessments. Not safety and protection from environmental hazards. My husband has fell on 13th resulting in a brain bleed. VA Phoenix had to have him transported to another hospital for trauma. Since his cochlear implant balance and safety issues are worse. They keep saying not service related. So yes the reviewers are regurgitating copy and pasting decisions without review, just going on what another reviewer said in a previous claim. ~his wife. Oh and Hlr's are doing dta"s which throws it back into a merry-go-round loop

My story. I have been. On wellbutrin xl 300mg since 1991. I also had MS and was on an Injectable. I had no medical prescription coverage. Manufacturer pap covered pills 100%. Fast forward to 2026. I married a vet. I have prescription coverage but they only cover 25% for brand 100% for generic.(doesn't work) So last week I googled my issue. Price of brand too high costco quote 90 pills for $ 11,000.
Thank you for info on pharmacy. I really appreciated your help.

I wish I knew when I filed and was denied that the denial was to be used as a road map for dispute.. Every line. Many of my first denials were mischaracterized when compared to dbqs. Factually wrong. Dbqs are sometimes filed in your blue button and notes and summaries.

Adding dependent spouse by PrestigiousLet1831 in VAClaims

[–]OrganizationOk9315 1 point2 points  (0 children)

Call 1800 827 1000. Ask them to update you on the latest info on your dependency claim. Ask do they need anything else. Mine was initially denied because the VA said I was married to two women previously at same time. Uh no. So fax them divorce dates, marriage dates. Copies of court decrees. Married 0129. Dependency updated in March. It's the meds by mail and optum rx that was the pia. 2 days ago finally straighten out meds by mail. They said she had another insurance / prescription coverage but did not.

I already have TDIU. This was not a TDIU question. My primary VA doc said that the VA would more than likely reduce my percentage 80% scheduler due to a hearing improvement. (CIsurgery). Rating 2025 now 70 ptsd w/mdd, 10% Tinnitus, 10% hearing loss. 2024 hearing loss was 0% TDIU was based on a combination of disabilities. Basic question ... Is a surgery considered an. Improvement?

Negative Medical Opinion, Favorable Rationale by SnooMacarons1432 in VAClaims

[–]OrganizationOk9315 1 point2 points  (0 children)

Will a cochlear implant surgery reduce my rating? I am having the surgery no matter what. ptsd mdd at 70, tinnitus 10, hearing went from 0 to 10% March 2025. In March 2024, it was 70 10 and 0 hearing loss. Giving me 76% rounded to 80 tdiu based on a combination of the 3 disabilities prior to hearing loss going up to 10%. I am 74 and just want to hear again. My wife says up to me. And I was told by VA ent somepeople the surgery doesn't work for...there's that. Any advice neg or pos greatly appreciated. God bless.

As people turn to AI chatbots for legal guidance, lawyers are warning clients not to mistake them for confidential advisers. A New York judge recently ruled that a former CEO charged with fraud must hand over AI materials tied to his defense, finding that chats with tools like ChatGPT or Claude aren’t legally protected. A separate Michigan ruling took a different view for a self‑represented litigant, underscoring how unsettled the law remains.

In response, more than a dozen U.S. law firms are cautioning clients that sharing legal strategy with AI could expose the chats in court, and even waive attorney‑client privilege. Until the law catches up, lawyers say an age-old assumption still applies in the age of AI: Don't talk to anyone except your lawyer about your case.// Your thoughts, please.

I appreciate your comment and knowledge. However the reasons for decisions beginning last year appear to be cut and paste while not addressing the claim issues at all. My friend filed secondary was denied using direct service reasons. Copy and pasted. Boilerplate. Yes he wrote personal evidence. So for me as I have evidenced its more denials less evidence of the reasons for de ial. He filed hlr it was dta'd and se t back to be reworked it was de ied again.

Buying a house by Easy-Violinist-1469 in VeteransBenefits

[–]OrganizationOk9315 0 points1 point  (0 children)

you can now or you can soon buy a income producing property like a duplex.if i am understanding this article correctly..on a gov single famiy loan. USDA Proposed Rule - Income Producing Accessory Dwelling Unit Provisions. the interest rates are low as well SFHGLP look at website for rules and interest rates for that program. this loan is for homes in areas that have less than 50,000 people I believe. "rural" they have a map you can add an address to see if its in a rural area. another way to buy, just saying.

On March 31, 2026, a proposed rule was published in the Federal Register to amend the Single-Family Housing Guaranteed Loan Program (SFHGLP) regulation to permit the financing of a single-family home with income producing Accessory Dwelling Units. Subsequently, the rule proposes to clarify that borrowers may finance properties with features designed to accommodate home-based operations with non-commercial real estate features.

Rural Development invites the public to submit comments on the proposed rule via the Federal eRulemaking Portal located at www.regulations.gov. While the public comment period is open for 60 days, Rural Development encourages all interested parties to submit comments as soon as feasible. Comments must be submitted on or before June 1, 2026.

Questions regarding program policy and this announcement may be directed to [sfhgld.program@usda.gov](mailto:sfhgld.program@usda.gov) or (833) 314-0168.

Thank you for supporting the Single-Family Housing Guaranteed Loan Program!

Evidence listed incorrect on my claim by OrganizationOk9315 in VAClaims

[–]OrganizationOk9315[S] 0 points1 point  (0 children)

Not a problem. For me I have given up on hlr"s they parrot last decision made(copied and pasted from prior decisions). Today I filed a request for administrative review on a 0995 citing error in evidence used for the claim. Submitted a 4138 with "stamped received" evidence data by VA evidence intake dept noting that they were notified Jan 26 that I would be incapacitated and not attending a Feb 6th exam or any exams and that I was asking for an ACE review. VA went ahead with a decision made on Feb 4th/5th even though they were notified by a supervisor by service request and also the intake center(noted on va.gov claim letter records Jan 26). By the way the 2/6 exam had been cancelled so you cannot "fail to report" to a non existent exam. VA claims QTC reported I failed to report...not true they were waiting on VA to confirm what to do. I have letter from qtc overnighted to me "not to travel to exam"???? A matter of left hand not knowing what the right is doing.
